Check temporary-building report uses, ordinary-structure thresholds, certificate expiry and renewal dates, with local ordinance and tax review prompts.

Korean 2026 building rules, checked 2026-10-30. Prepare a reporting-route and deadline review. Fill unknown conditions and compare the certificate and ordinance with the local authority.

1. Installation and reporting conditions

A container or similar structure for a temporary office, storage or accommodation

The former factory-rooftop exception through 2019 does not apply to new installations.

A qualifying Article 20(3) report use takes precedence over Article 20(1) permission.

Existence period and dates

Enter the certificate expiry first when available. Start date plus months is a scenario. Construction-site use has a project-completion proviso.

Used to flag multi-storey structural and escape-safety checks.

Extension: report by 7 days or apply for permission by 14 days before expiry. Authority notification: 30 days before expiry. Calendar reference dates require confirmation of holidays and actual filing availability.

Renewal eligibility and tax review

Blank means unknown; zero does not mean unlimited.

Distinguish acquisition tax exceeding one year from property-tax age under one year at June 1. Expiry is not demolition. With no actual demolition date, existence is assumed; demolition on June 1 remains pending. Confirm tax classification, exceptions and actual existence with the tax office.

This review prepares a local-authority consultation; it does not grant permission, establish structural safety or determine tax liability.

Check the reporting route before comparing installation costs

A temporary-building report concerns the use, location, construction and existence period of an installation, rather than its purchase price.
A container used for temporary storage differs from a permanent shop, and ground-level installation differs from a rooftop installation.
Owning the land does not by itself authorize every type of building or structure.

This calculator applies Korean 2026 building rules to a preliminary reporting-route, structure-threshold and renewal-date review.
It does not submit or accept a report.
Use its saved review when contacting the local city, county or district building authority before ordering an installation, or when an existing certificate approaches expiry.

Distinguish temporary buildings from ordinary structures

Temporary-building mode covers the uses in Building Act Enforcement Decree Article 15(5): designated disaster-area temporary use; events, exhibitions and direct-sale stalls; construction-site facilities; model homes; designated-area shops; prefabricated guardhouses; open-sided temporary garages; container offices, storage or accommodation; agricultural/fishery plastic greenhouses; livestock tents; fixed greenhouses and simple workrooms; factory/warehouse tents; temporary tourism/cultural events; outdoor exhibition/filming; smoking rooms; and similar buildings designated by ordinance.

Ordinary-structure mode reviews separately constructed retaining walls, fences, chimneys, towers, elevated tanks, underground shelters, steel towers, certain parking installations, solar equipment and ordinance-designated facilities.
Structures necessary for a construction project may instead follow Article 15(5), item 3: use temporary-building mode for that review.
Integrated building facilities and rooftop heavy loads need individual advice on separate construction, building alterations and local ordinances.

A planning-facility site does not always mean permission comes first

Building Act Article 20(1) requires permission for temporary buildings at urban/county planning facilities and proposed facility sites.
However, Article 20(3) expressly applies notwithstanding paragraph 1 and requires reporting before starting the prescribed temporary-building uses.
The calculator therefore checks Article 15(5) reporting-use conditions first; a qualifying report use is not automatically converted into a permit route because of the site.

If the report-use conditions are not met and the site is an existing or proposed planning facility, the result indicates a permit review.
Decree Article 15(1) requires no reinforced concrete or steel-reinforced concrete, an initial existence period within three years, no new trunk electricity/water/gas supply facilities, and no construction for sale such as apartments or sales facilities.
Building Act Article 20(2) also addresses buildings of four or more storeys.
Project obstruction, other laws and ordinances remain separate review matters.

A result outside the selected report-use category does not authorize installation.
Ordinary building permission/reporting or another ordinance category may apply.
Unknown conditions remain pending rather than being treated as an exemption.

Check size, materials, purpose and location together

A prefabricated guardhouse under item 6 has total floor area at most 10 m².
An outdoor smoking room under item 15 has total floor area at most 50 m².
Agricultural/fishery plastic greenhouses under item 9 require at least 100 m² and an urban residential, commercial or industrial zone.
Item 10 livestock, manure-treatment, livestock-exercise and rain-shelter plastic greenhouses/tents also require at least 100 m² and the prescribed use and materials.

For a container, confirm temporary office, storage or accommodation use and whether it is a new rooftop installation.
The former factory-rooftop exception through 2019 does not authorize a new installation in 2026.
Factory/warehouse or adjoining-site tents must also satisfy the storage, simple packing/repair or similar use and material conditions.
Item 16 depends on the current local building ordinance rather than a single national list.

The remaining-conditions answer is a factual confirmation, not a way to bypass the statutory requirements.
Do not select Yes merely because a name sounds similar when designation, an announcement or authority recognition is necessary.
Floor area and zoning are checked separately where required.

Use the calculator step by step

First gather the address, land-use confirmation, intended purpose and structural/area drawings, and select a mode.
Next select the use and answer the detailed conditions with Yes, No or Unknown.
If you have a certificate, copy its expiry date.
Otherwise enter a documented or assumed start date and a number of months as a scenario.

Enter the reference date for deadline comparisons and, for construction-site use, the actual project-completion date.
Check the ordinance extension-count limit, extensions already used, factory or agriculture/forestry-zone facts, renewal eligibility and any notice declining renewal.
Save the review as TXT or print it with the document checklist for the local authority or designer.
Blank numerical fields remain unknown rather than becoming zero.

Keep the existence period and the source of expiry separate

For report-based temporary buildings, Decree Article 15(7) sets an existence period within three years.
Renewals may be granted within three years per extension and for the number of extensions specified for the use by local building ordinance.
Construction-site temporary buildings and structures have the project-completion proviso, so a project longer than 36 months is not automatically rejected solely for that duration.

A verified certificate expiry takes precedence.
Without a certificate date, construction-site use refers to the completion date; other eligible routes use the start date plus entered calendar months as a scenario.
This does not declare the report-acceptance date to be the legal starting date.
For example, adding one month to 2026-01-31 produces 2026-02-28, while the actual certificate dates still govern.

If certificate expiry differs from completion, the later date is not automatically authorized.
Confirm project-period changes and existence-period procedures with the authority.
Ordinary-structure mode does not apply the temporary-building three-year limit or seven-day renewal rule.

Read the 30-day, 14-day and 7-day dates correctly

Decree Article 15-2 requires the authority to notify the owner of expiry and renewal eligibility by 30 days before expiry.
An owner seeking renewal must apply for permission by 14 days before expiry for permit-based buildings, or report by seven days before expiry for report-based buildings.
The authority-notification reference and the owner filing deadline are different dates.
Verify them directly even if a notification has not arrived.

For certificate expiry 2029-10-30, the notification reference is 2029-09-30.
The report-renewal reference deadline is 2029-10-23, while the permit-renewal deadline is 2029-10-16.
With reference date 2029-10-24, the report deadline is already one day past even though the building has not yet reached expiry.
Treat those two situations separately.

These are calendar dates counted backwards using the statutory periods.
The calculator does not move dates for public holidays or office closures.
Confirm actual filing availability and submit early.
It does not send reminders or file through the Korean building administration system on your behalf.

Factory installation alone does not establish deemed renewal

Decree Article 15-3 lists factory-installed temporary buildings, Article 15(5) item 11 buildings in a statutory agriculture/forestry zone, and temporary buildings on proposed planning-facility sites.
The building must also be eligible for an extension.
If the owner has not given notice declining renewal by the applicable deadline, the provision treats the period as renewed for the same duration.

A factory fact without verified renewal eligibility remains pending.
An entered notice declining renewal or an exhausted ordinance extension-count limit prevents a conditions-met result.
For a proposed site, renewal is limited to the period before the planning-facility project starts; an existing facility and a proposed site are different inputs.
Even a conditions-met indication is a reason to verify the actual renewal entry and management register with the authority.

Compare ordinary-structure thresholds precisely

Building Act Article 83 and Decree Article 118 govern the structure-report review.
For categories that say greater than, equality does not meet that numerical condition.
A fence exactly 2 m high does not meet item 5, but 2.001 m does.
Falling below one selected threshold does not remove requirements under other categories, ordinances, development rules or safety standards.

Mechanical or prefabricated steel parking installations are reviewed within the open-sided category at height at most 8 m, excluding protective railings.
Telecommunications towers also require the residential/commercial-zone condition.
Manufacturing, storage and amusement facilities, and heavy loads that substantially affect a building structure, require checking local ordinance designation.
Article 118(1), item 2 is deleted and is not presented as a current category.

For advertising towers or boards already permitted/reported under advertising law, confirm the reporting exception in the proviso to Article 118(3).
Do not assume either duplicate reporting or automatic omission solely from the height.
Reportable structures at least 8 m high require checking structural/seismic and wind-design confirmation documents under Building Act Enforcement Rule Article 41.

Distinguish acquisition tax exceeding one year from property tax under one year

Local Tax Act Article 9(5) provides temporary-building acquisition-tax treatment with an exception for existence exceeding one year.
The calculator flags a plan longer than 12 months, or a construction-to-expiry timeline exceeding one calendar year, for a tax review.
A plan of 12 months or less still needs rechecking if actual use continues or renewal extends it.
Tax-law temporary-building classification and special taxable exceptions are separate questions.

Article 109(3), item 3 concerns temporary buildings under one year old at the property-tax assessment date; Article 114 sets that date as June 1 each year.
For 2026-06-01, construction on 2025-06-02 is under one year, but construction on 2025-06-01 is exactly one year and does not meet that under-one-year exception.
Enter actual construction and assessment year, and actual demolition date if demolished.
Certificate expiry is not evidence of demolition and does not remove property-tax exposure.
With no demolition date, existence is assumed; demolition on the assessment date remains pending.

If previously exempt property becomes taxable, Article 20(3) refers to reporting/payment within 60 days from the triggering event.
Fixing every case to 60 days from the initial acquisition can therefore give the wrong deadline.
This tool does not calculate an acquisition-tax rate, assessed value, property-tax amount or confirmed tax-filing date.
Ask the local tax office about the taxable event and starting date before changing the period.

Prepare documents and use the review in practice

For report-based temporary buildings, Rule Article 13 covers the report, site plan, floor plan and landowner consent where the site belongs to someone else.
Check the required resolution evidence for a change to a condominium common area.
For extension reporting, check the current requirement for front, rear and both-side condition photographs taken within the month before filing.
Multi-storey facilities may need structural/escape-safety review, committee consideration or additional confirmation documents.

For ordinary structures, Rule Article 41 covers the report, site plan, structural drawing and size-dependent confirmations.
Separate form submission may be omitted where the relevant material was included with the building-permission application; confirm the exact route with the receiving department.
The checklist records preparation and does not certify that anything was filed.

Landowners can clarify temporary storage versus permanent business use before requesting quotes.
Factory managers can verify tent classification, ordinance limits and renewal eligibility before expiry.
Fence owners can check assessed height, boundary position and structural requirements before construction costs.
Agricultural huts and rural-stay shelters additionally require their specific farmland rules and the separate shelter-cost tool.

Principal structure-report numerical thresholds

Open-sided mechanical/prefabricated steel parking≤8 m
Solar generation equipment>5 m

These are representative numerical conditions.
Separately check ordinance manufacturing/storage/amusement facilities, heavy loads, separate construction and other laws.

Frequently asked questions

Can every container be installed through a temporary-building report?

No.
Confirm temporary office, storage or accommodation use, the exclusion of new rooftop installations, and other building/land requirements.
Calling a permanent shop or residence temporary does not make it eligible.

Does a 100 m² plastic greenhouse meet the area threshold?

Items 9 and 10 say at least 100 m², so equality meets the numerical condition.
Item 9 additionally requires the urban residential/commercial/industrial zone and agricultural/fishery use; item 10 has its own livestock-related uses and materials.

Does a proposed planning-facility site always require permission?

Article 20(3) applies notwithstanding paragraph 1.
Check the qualifying reporting-use conditions first.
If they are not met, consider the planning-facility permit or ordinary building procedures.

Is report acceptance plus 36 months the confirmed expiry?

Check the certificate and management register.
Start plus months is a calendar scenario; this tool does not automatically adopt report acceptance as the legal start date.
A verified certificate expiry takes precedence.

Does a factory location automatically remove renewal reporting?

The building must also be eligible for renewal, and no notice declining renewal must have been given by the applicable deadline.
Verify ordinance limits, the register and actual renewal status.
Factory location alone does not mean indefinite existence.

Is a fence exactly 2 m high exempt from every report?

It does not meet the greater-than-2-m condition in Article 118(1), item 5.
Other structure categories, ordinances, development, boundaries and structural requirements still need review.
Confirm the assessed height and applicable procedures.

Is a one-year temporary building free of all taxes?

Acquisition tax uses an exceeding-one-year condition, while the property-tax exception uses under one year at the assessment date.
Exactly one year does not satisfy the latter.
Confirm actual existence, tax classification and exceptions with the tax office.

What if installation starts before reporting?

Building Act Article 111, item 1 provides a fine up to KRW 50 million for failing to report or falsely reporting contrary to Article 20(3).
Actual penalties, correction and enforcement charges depend on the facts.
Confirm the route before installation, or contact the authority about an existing installation.
