The first visible EB-5 number is usually USD 800,000 or USD 1,050,000, but neither amount is a complete household funding plan.

Administration, legal, diligence, medical, and travel costs vary with the project, family, source-of-funds record, jurisdiction, and scope of representation.
Their defaults are zero so that a generic estimate is not mistaken for a quote.

Current statutory investment tiers and core boundaries

The version of 8 U.S.C. §1153(b)(5) checked on August 3, 2026 sets USD 1,050,000 as the standard investment amount and USD 800,000 for a targeted employment area or infrastructure project.
The statute also describes at least ten full-time jobs for qualifying US workers and an expectation that the capital remain invested for at least two years.
The two-year rule is a statutory sustainment boundary, not a promise that a project will return cash exactly two years after funding or conditional residence.
Offering terms, loan maturity, redeployment authority, construction progress, operating results, liquidation, and market conditions can extend the practical lockup.

The statute schedules the first automatic inflation adjustment for January 1, 2027 and further adjustments every five years.
A filing planned for 2027 or later therefore needs a fresh statutory and USCIS check before the household commits to a funding amount.
The statute also excludes arrangements that give the investor a contractual right to repayment or a guaranteed rate of return from qualifying capital.
A 100% recovery input in this calculator is only a scenario endpoint and must never be described as guaranteed principal.

Why current EB-5 fee searches can be misleading

An online fee search can surface both the 2024 fee-rule amounts and a later court-order notice.
USCIS states that a November 12, 2025 court order partially stayed the EB-5 portions of the 2024 fee rule and that the prior fees were reinstated beginning November 13, 2025.
The notice identifies USD 3,675 for either Form I-526 or Form I-526E and USD 3,750 for Form I-829.
It also identifies the higher USD 11,160 and USD 9,525 amounts as amounts not to pay under that posture.
This calculator therefore uses the reinstated base fees, while still including the separate USD 1,000 EB-5 Reform and Integrity Act fee for a regional-center I-526E filing.

Consular processing and adjustment of status

Consular-processing scenario

The State Department fee table lists USD 345 per person for an employment-based immigrant visa application based on an approved I-526 petition.
The calculator also adds the current USCIS immigrant fee of USD 235 per person.
Medical examinations, vaccinations, civil records, translations, police certificates, courier services, and interview travel vary by post and family, so they remain user-entered quotes.

Adjustment-of-status scenario

The model uses USD 1,440 for each applicant age fourteen or older and USD 950 for a child under fourteen filing with a parent.
It adds USD 260 for each selected I-765 employment-authorization applicant and USD 630 for each selected paper I-131 advance-parole applicant.
These are cost inputs, not an eligibility decision.
Visa-number availability, maintenance of status, concurrent filing, travel consequences, and each family member’s adjustment eligibility require current case-specific review.

The later I-829 stage

USCIS instructions generally place the I-829 filing in the 90-day window immediately before the second anniversary of conditional permanent residence.
A qualifying spouse and children may be included with the principal investor, so the model applies one base I-829 government fee to the household scenario.
If a family member needs a separate petition, add the separately confirmed filing and professional cost under other cost.

What each result means

Lifecycle USD outlay

This equals statutory investment principal plus government fees plus every entered private quote.
It is a nominal budget and does not subtract an assumed future recovery because the household must fund the investment before any possible exit.

Initial and later-stage funding

Initial funding includes principal, the investor petition, the regional-center integrity fee when applicable, project administration, initial legal work, and diligence.
The remainder preserves later immigration, medical, document, travel, I-829, and entered I-829 legal expenses as a separate reserve.

KRW funding with spread

The calculator multiplies lifecycle USD outlay by the entered funding rate, adds the percentage spread, and then adds fixed KRW wire charges.
Multiple transfers will occur at different rates and charges, so this is a single weighted-rate scenario rather than a transfer instruction.

Opportunity gap

Alternative future value compounds the investment principal at the entered alternative annual return for the entered lockup period.
The model subtracts assumed recovered principal and simple cumulative project distributions to show a comparison gap.
It does not model tax, inflation, distribution timing, reinvestment, or the probability of either scenario.

Principal shortfall

Principal shortfall is the statutory investment amount multiplied by one minus the entered recovery rate.
It isolates credit and project-loss stress from currency movement, but it is not a forecast of the actual loss.

Exit FX effect

The FX effect multiplies assumed recovered USD principal by the difference between the exit and funding exchange rates.
It excludes the principal shortfall so that a lower recovery rate and a weaker or stronger KRW are not described as the same risk.

Worked example for one regional-center investor

Start with the USD 800,000 targeted-employment-area or infrastructure tier, a regional-center I-526E petition, consular processing, one adult applicant, and zero private quotes.
The government-fee model adds USD 3,675 for I-526E, USD 1,000 for the integrity fee, USD 345 for the employment-based immigrant visa, USD 235 for the USCIS immigrant fee, and USD 3,750 for I-829.
Government and non-investment cost is USD 9,005, while lifecycle outlay is USD 809,005.
At KRW 1,400 per USD with no spread or fixed wire charge, the modeled funding requirement is KRW 1,132,607,000.

Lockup and recovery stress example

Consider USD 800,000 locked for five years, a 4% alternative compound return, no project distribution, and 90% principal recovery.
The alternative future value is about USD 973,322.32, while assumed project end value is USD 720,000.
The resulting opportunity gap is about USD 253,322.32 and the principal shortfall is USD 80,000.
If the entry rate is KRW 1,400 per USD and the exit rate is KRW 1,300, the currency effect on the assumed USD 720,000 recovery is negative KRW 72,000,000.
The opportunity gap already compares ending values, while principal shortfall and FX effect explain separate drivers, so do not automatically add all three as if they were independent invoices.

Korean foreign-exchange classification is a separate decision

A resident of Korea may need to complete a foreign-exchange report or acceptance process before remitting capital.
Article 18 of the Foreign Exchange Transactions Act supplies the general capital-transaction boundary, while Article 8 of its Enforcement Decree describes foreign direct investment through ownership and continuing economic relationships.
Article 32 addresses reporting procedure, and Article 9-5 of the Foreign Exchange Transactions Regulations addresses reporting through a designated foreign-exchange bank when a transaction is foreign direct investment.
An EB-5 new commercial enterprise can use a corporation, limited partnership, equity interest, loan structure, or governance terms that do not fit a classification based on the amount alone.
This calculator therefore does not label the remittance as foreign direct investment, acquisition of foreign securities, another capital transaction, or overseas-migration expense.

  • Show the NCE organizational documents, subscription agreement, funds-flow diagram, and recipient account to the designated foreign-exchange bank before funding
  • Ask the bank to document the reporting category, timing, responsible branch, required evidence, and any post-investment reporting
  • Keep Korean source-of-funds, tax, conversion, and transfer records consistent with the evidence submitted in the US petition
  • Confirm the procedure for split transfers, refunds, distributions, and a later return of principal

Source of funds and project diligence remain outside the formula

EB-5 evidence reaches beyond the investment principal because capital and relevant administration charges may need a lawful-source and lawful-path explanation.
Salary, business income, asset sales, gifts, inheritance, secured borrowing, taxes, and transfers should form a consistent documentary chain.
The calculator cannot test whether a record is complete, credible, translated correctly, or consistent across jurisdictions.
When comparing legal quotes, identify whether source-of-funds analysis, family derivatives, translation coordination, requests for evidence, consular or adjustment work, and I-829 work are included or separately billed.

A lower quoted cost does not resolve differences in redeployment authority, capital stack, collateral, conflicts, job creation, or exit risk.

Set a KRW liquidity buffer

Run the same USD outlay at several funding rates and spreads, such as KRW 1,350 and KRW 1,450 per USD.
The range is a treasury stress test, not an exchange-rate forecast or a recommendation to time the currency market.

Compare a five-year and seven-year lockup

Keep recovery and alternative return assumptions constant while extending only the lockup.
This highlights the economic effect of project delay without confusing the statutory sustainment floor, immigration processing, and actual liquidity date.

Build an initial and later-stage reserve

Use initial funding for the project and petition phase, then reserve the later-stage result for consular or adjustment costs, family medical and travel costs, I-829, and separately quoted legal work.
