A cancelled gift does not automatically erase every tax and registration

A family agreement to reverse a gift and put the asset back in the donor’s name does not, by itself, make every tax liability and registration cost disappear. The review changes with the asset type, the date on which the return is legally completed, whether the Korean tax authority determined the gift-tax base and amount before the return, and whether a real-estate title transfer was already registered.
The completion date deserves special care. A signed cancellation agreement can be evidence of intent, but it may not be the tax completion date. For cash, trace the bank transfers in both directions. The Korean gift-tax return windows

Article 4(4) of the Korean Inheritance Tax and Gift Tax Act separates non-cash returned gifts by time. Article 68 generally sets the gift-tax filing deadline at three months from the end of the month containing the gift date. If a non-cash gifted asset is returned by mutual agreement by that deadline, before the gift-tax base and amount have been determined, the original gift can fall within the rule that treats it as if the gift had not occurred.
If the non-cash asset is returned or re-gifted after the filing deadline but within the following three months, tax on the original gift may remain while the transfer back can fall within the additional statutory window. Once that additional period has ended, both the original gift and the transfer back can require separate gift-tax review.
The calculator deliberately labels these outcomes as review windows. It does not know whether the parties formed an effective agreement, whether the entire asset was actually restored, whether a tax determination had already occurred, whether the return evidence is accepted, or whether another transaction occurred in the interim.

Calendar example

For a gift made on May 10, 2026, the calculator produces August 31, 2026 as the filing deadline and November 30, 2026 as the end of the additional return window. A return completed on August 31 remains in the first date band. A return completed on November 30 remains in the additional band. A return completed on December 1 falls after it.
For real estate, do not substitute the date on which the family agreed to act for the date on which title was actually restored. If an agreement is signed on August 31 but the title return is completed in September, ask which completion date controls before relying on the first band.

Cash is expressly outside the returned-property rule

Cash is excluded from the returned-property treatment in Article 4(4). Sending the same amount back does not automatically erase the legal and tax significance of the first transfer. The original payment and the payment back can each require gift-tax analysis, even when the family account balances appear to have returned to their starting position.
This is why selecting cash overrides the ordinary date classification. The calculator shows a cash warning even when the planned return falls before the filing deadline. It also removes real-estate acquisition tax and registration fees from the result. Users should enter separately confirmed tax amounts for the original cash gift and the transfer back instead of asking the tool to infer them from the principal amount.

Real-estate acquisition tax depends heavily on registration and proof

The Korean Local Tax Act can impose acquisition tax on a factual acquisition even when registration has not been completed. The absence of a title filing is therefore not, on its own, proof that acquisition tax never arose. Article 20 of the Local Tax Act generally uses a three-month period from the end of the month containing a gratuitous acquisition, subject to an earlier payment point when registration occurs before that deadline.
Article 20(1) of the Enforcement Decree provides a route for certain unregistered gratuitous acquisitions to be treated as not acquired when cancellation is proved within the statutory period through specified records, a notarised instrument, or the official cancellation filing. The conditions and accepted evidence matter. Once the original gift registration is complete, the calculator does not apply this unregistered route and instead displays a local-authority review warning.
Historical local-tax interpretations also show why the tool avoids an automatic refund. Some registered-gift cancellation cases preserved the original acquisition-tax liability, while a judicial finding about the invalidity of the original transaction could change the analysis. Current legislation and the user’s exact facts must control.

Base statutory reversal-registration cost

When the original real-estate gift registration is complete, the calculator uses the statutory standard rate for an otherwise classified real-estate registration: KRW 6,000 per user-confirmed registration-license tax case. It adds local education tax equal to 20% of that registration-license tax.
It then applies the base application fee for other registrations per property: KRW 1,000 for electronic filing, KRW 3,000 for an electronic standard form, or KRW 4,000 for a paper filing. One property, one registration-license tax case, and a paper filing therefore produce KRW 6,000 of registration-license tax, KRW 1,200 of local education tax, and KRW 4,000 of application fee, or KRW 11,200 in total.
That amount is only a statutory base. It excludes professional fees, certificates, notarisation, service, litigation, third-party-right processing, possible bond transactions, and any charge created by the exact filing structure. A local ordinance can vary the standard registration-license rate within the statutory range. Use the registry-office and local-government assessment for the final amount.

How the cash-flow model works

A date can be favourable while the cash outcome is still expensive. Original registration charges and professional fees may be unrecoverable. A tax refund may be delayed until after new registration and adviser costs are paid. A return or re-gift can also generate a separately confirmed tax amount. The calculator keeps these layers visible instead of presenting one unexplained net figure.

When a simple cancellation becomes a complex case

Only part of the asset returns

Record the actual returned value and preserve the remaining ownership history. Tax bases, deductions, filing units, and acquisition-tax objects may not divide in the same proportion as market value. Obtain a separate calculation for the returned and retained portions.

A mortgage or attachment exists

Cancellation registration can affect a registered third party. Korean registration law can require consent from an interested third party, and a debt change can create tax and civil consequences beyond the base filing fee.

The donee received rent or used the asset

Rent, use benefits, expenses, depreciation, possession, and the return of income can affect separate tax returns and restitution claims. The calculator only adds a warning and does not value those items.

The asset was sold or pledged

A sale, pledge, replacement asset, or third-party payment can prevent a simple in-kind return and introduce capital-gains, acquisition, financing, tracing, and damages questions. Resolve the legal path before relying on the cost model.

Frequently asked questions

Does signing a cancellation agreement before the deadline eliminate gift tax?

No automatic conclusion follows. For the non-cash first-window rule, verify an effective mutual return, actual restoration by the deadline, and the absence of a prior tax determination. Real-estate title records can make the completion date different from the signature date.

Does returning the same cash cancel the first gift?

Cash is expressly excluded from the statutory returned-property rule. Review the original payment and the payment back as separate potential gifts, document the transaction basis and funding, and confirm both filing positions.

Is acquisition tax fully refundable after a registered gift is reversed?
