What is the Korea administrative disposition stay value calculator?
This calculator organizes the financial consequences of a Korean business suspension, professional-license suspension, permit cancellation, registration cancellation, or another administrative disposition that can interrupt operations.
It goes beyond the quoted cost of the main administrative action or appeal by separating lost contribution margin, cash costs that continue during shutdown, contract and restart losses, the stay-application quote, and any confirmed security cash.
The result compares three assumptions using the same evidence: no stay application, a granted stay, and a denied stay.
It does not multiply the amounts by a grant probability, predict the merits, or decide whether monetary harm is legally irreparable or serious.

Filing the main challenge does not automatically stop the disposition
Article 23(1) of the Korean Administrative Litigation Act states that filing a cancellation action does not affect the disposition, its enforcement, or the continuation of the procedure.
Article 23(2) allows the court hearing the pending main action to suspend all or part of the disposition, enforcement, or procedure when urgent necessity is recognized to prevent irreparable harm.
Article 23(3) bars a stay where it may seriously affect the public welfare, and Article 23(4) requires a prima facie explanation of the grounds for the request.
Article 30 of the Korean Administrative Appeals Act follows the same no-automatic-stay starting point for an administrative appeal.
The commission may order all or part of a stay when there is urgent necessity to prevent serious harm and no serious public-welfare concern.
Under Article 30(5), the written stay request is filed with the main appeal or before the commission or subcommission votes on that appeal.
Administrative litigation route
The court with the pending cancellation action decides the stay request.
Article 23 does not create a separate numerical deadline measured as a fixed number of days from the disposition.
Counsel must confirm venue, the status of the main filing, live enforcement, urgency, and when a useful stay can still be requested.
Administrative appeal route
The written request is submitted with the main appeal or before the commission decision.
Supporting documents or materials may be attached to explain the reasons, and an application delivered to the respondent agency must be forwarded to the commission without delay under Enforcement Decree Article 22.
The notice and the responsible commission remain the controlling procedural sources.
The displayed main deadline is not a standalone stay deadline
The tool shows the ordinary cancellation-action references of 90 days from knowledge and one year from disposition, or the ordinary cancellation-appeal references of 90 days from knowledge and 180 days from disposition.
These dates help identify a possible main-proceeding timing problem; they are not labelled as an independent stay-application deadline.
Special statutes, mandatory exhaustion, a post-appeal-decision accrual date, nullity, justifiable cause, Korean public holidays, and venue remain outside the automatic result.
Why economic loss and cash buffer are different
Adding revenue, payroll, rent, and profit into one shutdown-loss total can count the same fixed cost twice.
This model uses contribution margin to measure the difference between normal operations and shutdown, while it uses fixed cash outflow to estimate how much cash must remain available during the interruption.
Contribution margin
Enter revenue less costs that fall when sales stop, such as materials, purchases, transaction fees, or platform commissions.
It represents the daily economic value lost when the operation cannot trade.
Fixed cash outflow
Enter rent, essential payroll, lease payments, and system costs that are actually paid while operations are stopped.
These amounts are used for the survival cash buffer, not added again to contribution-margin loss.
Contract and one-time loss
Separate daily delay, storage, or substitute-supply loss from one-time cancellation, disposal, and restart costs.
Then separate a loss that a timely grant can avoid from a loss already incurred or unavoidable under every outcome.
Four duplication checks
- If contribution margin excludes only variable cost, do not add rent and fixed payroll again to economic loss.
- If a cancellation amount is entered as a one-time loss, do not divide and enter the same amount as a daily contract loss.
- Put an amount already paid in unavoidable loss, not avoidable loss.
- Treat recoverable security principal as temporarily locked cash; treat confirmed interest or guarantee fees as economic cost.
How to prepare each input
1. Transcribe dates from the notice and delivery evidence
Keep the disposition date, the date the disposition became known, and the effect or enforcement date in separate fields.
Use the actual filing receipt or a planned filing date for the main proceeding.
The assumed stay-decision date is only a comparison date and never a forecast or promised grant date.
2. Reconcile contribution margin from the ledger
If the business is seasonal, compare months that resemble the disposition-effect period instead of relying on one recent month.
Deduct costs that genuinely disappear with sales, and move rent, fixed salaries, leases, and other continuing payments to fixed cash outflow.
Keep value-added tax and accounting treatment consistent across the schedule.
3. Classify avoidable and unavoidable contract loss
Disposal, prepaid fees, or minimum storage charges incurred before a decision belong in unavoidable one-time loss.
Cancellation, restart, or additional disposal charges that a timely stay would prevent belong in avoidable one-time loss.
A disputed counterparty claim should remain a separate scenario until the amount and basis are sufficiently documented.
4. Use scoped procedure and security quotes
Confirm whether the main-proceeding and stay-application quotes overlap in drafting, evidence review, hearings, expenses, or value-added tax.
Security is not presented as a universal statutory default for an Article 23 stay.
Leave principal at zero unless a case document or professional quote gives a confirmed amount, financing rate, and likely lock-up period.
Formula and result interpretation
Daily economic loss
The model divides monthly contribution margin by 30 and adds documented daily contract loss.
Multiplying by the full impact period gives the no-application and denied operating loss.
Multiplying by the days from effect to the assumed decision gives the pre-decision operating loss under the granted assumption.
Net benefit if granted
Net benefit equals the no-application economic burden minus the granted-stay economic burden.
It is also the operating and one-time loss avoided after the assumed decision, less the application quote and security financing cost.
A negative value is a budget result only; it does not decide whether an urgent legal request remains necessary.
Break-even stay days
Subtract avoidable one-time loss from the granted-stay economic cost, divide the remaining cost by daily economic loss, and round up.
The result is zero when avoidable one-time loss alone covers the application and financing cost.
It is unavailable when daily loss is zero and avoidable one-time loss remains below the cost.
Required cash buffer
Convert monthly fixed cash outflow to the scenario impact days, then add main cost, stay cost where applicable, and one-time cash loss.
The granted scenario also includes confirmed security principal as locked cash, but economic burden includes only financing cost.
Cash gap is the amount by which that buffer exceeds cash available now.

The default is a synthetic example for checking the model, not a market fee or a recommended budget.
Replace every date and amount with the Korean notice, books, contracts, and scoped quotes for the matter.
Sixty impact days and a decision assumed ten days after effect
- Monthly contribution margin is KRW 18,000,000, monthly fixed cash outflow is KRW 10,000,000, and daily contract loss is KRW 100,000.

Daily economic loss is KRW 700,000: KRW 600,000 of daily contribution margin plus KRW 100,000 of daily contract loss.
The granted assumption avoids 50 impact days and KRW 1,000,000 of one-time loss, producing KRW 33,000,000 of net benefit after the KRW 3,000,000 application cost.
Subtracting the KRW 1,000,000 avoidable one-time loss from the application cost and dividing by KRW 700,000 gives a three-day break-even after rounding up.
Practical scenarios
Restaurant or manufacturing suspension
Put spoiled inventory and reservation cancellation in one-time loss, daily delivery penalties in contract loss, and rent plus minimum staffing in fixed cash outflow.
For a seasonal operation, run low, base, and high contribution-margin versions instead of presenting one month as certain.
Professional qualification or license suspension
Separate net income genuinely lost because work cannot be performed from substitute staffing and office-preservation cash.
The governing professional statute may have a different exhaustion route or filing period, so bring the actual notice with the calculation.
Permit or registration cancellation
Separate contracts that terminate immediately from contracts with a cure or grace period.
Enter restart or relicensing cost as avoidable only when a timely stay can actually prevent that cost under the document set.
Keep unsupported reputation or future-growth estimates outside the confirmed total.
Confirmed security or guarantee quote
Counting all security principal as permanent loss overstates economic burden when the principal may be returned.
The tool puts principal in the granted cash buffer and puts documented guarantee fee, borrowing interest, or financing cost in economic burden.
