Korean Inheritance Redistribution Gift and Acquisition Tax Deadline Calculator
Compare Korean national and local inheritance redistribution deadlines, confirmed acquisition and registration dates, ten-year gifts and deductions, and additional gift and acquisition taxes under 2026 rules.
The initial values are fictional. Confirm acquisition dates, registration effect, prior gifts, deductions and exceptions for your case. Totals include gift tax and acquisition tax only; local education tax, rural surtax, penalties and registration costs are separate.

Why acquisition and registration need separate dates
Families sometimes register an estate in statutory shares and later concentrate a home or land in one heir.
Agreement among the heirs does not settle the tax treatment.
Article 4(3) of the Inheritance and Gift Tax Act and Article 7(13) of the Local Tax Act separately address property acquired beyond a previously fixed inheritance share.
This calculator is based on Korean rules for 2026; it does not apply foreign inheritance law.
Use this tool after deciding the allocation itself.
It compares one confirmed donor–recipient pair and one property.
Enter the agreement, confirmed national-tax acquisition, confirmed local-tax acquisition and effective registration dates separately.
It does not proportionally assign legal donors from several heirs or net transfers across different properties.
An agreement signature alone is not treated as proof of national-tax acquisition.
Six months normally; distinguish the foreign-address conditions
Inheritance and Gift Tax Act Article 67 normally allows six months from the end of the month in which inheritance starts.
It allows nine months if the decedent or an heir has a foreign address.
Local Tax Act Article 20(1) uses six months, extended to nine where an heir has a foreign address.
A foreign-address decedent with only domestic-address heirs can therefore produce different national and local deadlines.
Nationality alone does not establish either condition.
These are month-end periods, not 180 days.
Framework Act on National Taxes Article 5 and Framework Act on Local Taxes Article 24 move deadlines falling on Saturdays, Sundays, public or substitute holidays, or Labor Day to the next eligible day.
For inheritance on 2026-04-10, the nominal deadline 2026-10-31 falls on Saturday, giving 2026-11-02.
The calendar runs through 2027; temporary holidays and individual extensions require confirmation.
Enter whole-property values and the increase in shares
Provide the whole-property gift valuation and the separately confirmed whole-property gift acquisition tax base.
An increase from 50% to 100% is a 50-percentage-point transfer.
With a value of KRW 600,000,000, the increased value is KRW 300,000,000.
Increased value = whole-property value × max(new share − original share, 0) / 100.
Amounts are KRW, shares permit two decimal places, and fractional won are discarded.
National market value and the local acquisition base need not match.
Local Tax Act Article 10-2 generally uses the officially assessed value for inheritance and recognized market value for a gift, with statutory exceptions.
Do not copy an assessed value into both fields without checking.
Enter the whole-property base, not an amount already multiplied by the transferred share; otherwise the share would be applied twice.
Relationship deductions and ten-year aggregation are different records
The ordinary ten-year deduction is KRW 10,000,000 for qualifying siblings and other relatives, KRW 600,000,000 for a spouse, KRW 50,000,000 for an adult receiving from a direct ascendant or a recipient receiving from a direct descendant, and KRW 20,000,000 for a minor receiving from a direct ascendant.
This tool covers ordinary deductions for Korean-resident recipients.
Generation skipping, marriage and childbirth relief require separate review.
The KRW 10M allowance does not restart for each sibling.
Enter deductions already used throughout the applicable relationship category.
Separately, Article 47(2) aggregates prior ten-year gifts from the same donor if their sum is at least KRW 10,000,000.
Below that amount, prior gifts are excluded from aggregation, but previously used deductions remain used.
Confirm statutory same-donor groupings, including a direct ascendant and that ascendant’s spouse.
Current deduction is the smaller of the increased value and remaining category allowance.
The combined tax base is current value minus current deduction plus aggregated prior value minus the deductions applied to that prior value.
Under Article 55(2), a base below KRW 500,000 attracts no gift tax.
Exactly KRW 500,000 falls outside that exemption.
Progressive rates, prior-tax credit and the filing credit
Articles 26 and 56 apply 10% through KRW 100M, 20% above 100M through 500M, 30% above 500M through 1B, 40% above 1B through 3B, and 50% above 3B.
The corresponding progressive offsets are KRW 0, 10M, 60M, 160M and 460M.
Each part of the tax base is taxed at its marginal bracket rate rather than applying the highest rate to the entire gift.
Article 58 credits the calculated tax on aggregated prior gifts, capped at combined calculated tax × prior taxable base / combined taxable base.
The input is prior calculated gift tax paid or payable, which may differ from the cash remitted after credits.
Article 69 provides a 3% timely-filing credit after the prior-tax credit.
Turn off timely filing to remove that credit.
Penalties and other specialized credits are excluded.
Acquisition tax requires both acquisition and registration in time
The ordinary timing exception in Local Tax Act Article 7(13) requires redistribution acquisition and registration to be completed within the inheritance filing/payment deadline.
Signing an agreement while registration is delayed may leave a gift-acquisition liability.
This comparison does not charge the original inheritance acquisition tax again: its in-time additional gift-acquisition tax is zero.
That does not remove the original inheritance filing obligation.
Ordinary gift acquisition tax under Article 11(1)2 is 3.5%.
Homes may have Article 13-2 surcharges and exceptions based on area, value and relationship; high-end property may trigger Article 13, and relief needs separate confirmation.
Unless ordinary 3.5% treatment is confirmed, taxable acquisition amounts and their totals are withheld.
A home checkbox does not decide the rate.
Local education tax and rural surtax are separate.
Exceptions differ: payment-in-kind refusal is national only
Inheritance Tax Decree Article 3-2 lists a final inheritance-recovery judgment changing heirs or property, redistribution after creditor-subrogation registration in statutory shares, and qualifying payment-in-kind refusal or property-change orders after an application made within the inheritance filing period.
A later family preference or verbal agreement is not automatically a statutory exception.
Select an exception only after checking its complete conditions and evidence.
Local Tax Act Article 7(13) lists inheritance recovery and creditor subrogation but does not list the same payment-in-kind exception.
Selecting payment-in-kind refusal therefore removes national gift tax only; the local acquisition and registration timing still matters.
A confirmed exception also applies in hypothetical rows B and C.
The calculator does not decide whether a judgment, subrogation or payment-in-kind application is legally effective.
Worked example: timely acquisition, delayed registration
Assume inheritance on 2026-04-10, agreement and confirmed national/local acquisition on 2026-10-20, registration application on 2026-11-06 and effective registration on 2026-11-10.
There are no foreign addresses or statutory exceptions.
Both whole-property values are KRW 600,000,000, and the recipient’s share rises from 50% to 100%.
The parties are siblings with no previous gifts or deduction usage, and ordinary 3.5% acquisition treatment is confirmed.
Both deadlines are 2026-11-02.
Row A, completed within both deadlines, has zero additional principal taxes.
Row B has acquisition tax of KRW 10,500,000 because registration is late.
In row C, national acquisition is also late: the gift tax base is KRW 290,000,000, calculated tax KRW 48,000,000, filing credit KRW 1,440,000 and final gift tax KRW 46,560,000.
Including acquisition tax gives KRW 57,060,000.
The entered schedule corresponds to B, assuming the national acquisition date has been confirmed with the authority.
How to use the form and plan the subsequent filings
First confirm that original shares were already fixed by registration.
Enter inheritance and foreign-address facts, then separately confirm the agreement, each tax acquisition date, registration application and effective registration date.
Add whole-property values, shares and the prior-gift records.
If records are missing, clear factual confirmation and obtain the evidence before relying on a result.
Where gift tax is payable, Article 68 normally sets a deadline three months after the end of the gift month.
Local gift acquisition also uses acquisition-month-end plus three months, but Article 20(4) requires filing and payment by an earlier registration application date.
In hypothetical C with a gift on 2026-10-20, national filing is due 2027-02-01.
In the actual B example, acquisition payment must be prepared by 2026-11-06, the earlier application date.
A zero actual national liability is not displayed as a mandatory gift tax payment deadline.
Keeping shares or selling: compare the same cost scope
Keeping the existing shares creates no transfer now, so additional transfer tax is zero.
Future holding taxes, management contributions and agreement on disposal remain separate concerns.
A share sale is not automatically preferable merely because it is called a sale: check the seller’s capital gains tax, buyer’s acquisition tax, transaction costs and actual payment.
Related-party undervaluation or a nominal sale requires further review.
Enter a confirmed combined sale quote yourself.
Without confirmation it is withheld rather than shown as zero.
The redistribution rows contain gift tax and acquisition principal only, while a sale quote may include fees; align the included items before choosing.
The timing rows hold values and history fixed to isolate timing.
A real change of date can change valuations and the ten-year window, requiring a fresh calculation.
Frequently asked questions
Is every redistribution after statutory-share registration a gift?
An acquisition above a fixed share is generally reviewed, subject to separate national/local timing and exception rules. This tool covers redistribution after the original shares were already registered.
Is signing before the deadline sufficient for acquisition tax?
Local law separately requires timely acquisition and registration. National acquisition also uses a confirmed date; the tool does not infer it from a signature.
Does a foreign-address decedent give nine months for local tax?
The verified local provision refers to an heir with a foreign address. National law refers to the decedent or an heir, so the conditions are separate.
Can I deduct KRW 10M for each sibling?
Check ten-year usage throughout the deduction category. Summing separate runs can duplicate an allowance; concurrent gifts from multiple donors need separate review.
What if ordinary 3.5% treatment is unconfirmed?
Taxable acquisition tax and the associated totals are withheld. An available gift-tax result does not turn an unknown combined liability into zero.
Does payment-in-kind refusal exempt both taxes?
The verified decree exception applies to national gift tax. Local acquisition timing and separately listed exceptions still need checking.
Does the table include the original inheritance acquisition tax?
No. It compares additional principal taxes on redistribution. Original inheritance tax, local education tax, rural surtax, penalties and fees are separate.
Is a sale always better after the deadline?
Compare confirmed capital gains tax, acquisition tax, fees and genuine payment with redistribution using the same cost scope before changing the contract.
