Civil partition routes

When heirs cannot agree on a partition, Civil Act Article 269(2) allows partition by sale through a formal auction. The Korean calculator compares negotiated sale, one heir buying the others, third-party share transfer, and lawsuit-to-auction routes.

A voluntary sale is often the cleanest route, but selling only an inherited share can require a 10 to 20 percent discount. The one-house exemption threshold at KRW 1.2 billion can also change whether keeping or selling the asset is tax-efficient for a particular heir.

Buyout, lawsuit, and auction cost

If one co-owner buys the others, acquisition tax can range from 1 to 12 percent depending on housing count and regulated-area status. First-home acquisition at or below KRW 1.2 billion can receive up to KRW 2 million of reduction, while a sibling transaction that differs from fair value by more than 5 percent can be treated as a deemed gift issue.

Partition litigation cost is modeled with stamp tax around 0.35 to 0.5 percent, service cost of KRW 50,000 per party for 4 to 6 rounds, appraisal cost near 0.05 to 0.3 percent with a practical KRW 2 million to KRW 15 million range, lawyer fees from roughly KRW 2 million to KRW 100 million, and registration license tax of 0.2 percent.

Tax and discount warning

A formal auction usually realizes only 70 to 85 percent of market value, which means a 15 to 30 percent value loss can dominate the litigation fees themselves. The calculator shows that discount separately so users do not mistake auction filing cost for total economic cost.

Capital gains tax keeps the 6 to 45 percent progressive structure plus 10 percent local income tax. Short-term housing transfer can be 70 percent under 1 year and 60 percent for 1 to 2 years, while non-housing short-term branches use 50 percent and 40 percent; long-term holding deduction begins after 3 years and can reach 30 percent in the source model.
