Plan a move after tacit renewal with dates and a rent ledger
After a lease continues without a new express agreement, the notice date and the final rent interval can affect both the moving budget and the next home’s closing payment.
Dispatch, receipt, the end of a statutory period, actual handover and deposit return describe different events.
Recording them as one date can leave an unexpected cash gap.
This calculator uses Korean law and the 2026 rule set verified on October 15, 2026.
It covers a tenant’s termination notice after an existing tacit renewal of a housing lease or a commercial lease within the relevant statutory coverage.
It builds a timeline from receipt and a rent ledger from your first settlement date through the day before termination takes effect.
Save the result to discuss handover and deposit return; the tool does not send a notice or arrange payment.
Decision to verify
Check the renewal type and receipt evidence, identify the conditional effective date at 00:00, and review the rent principal needed through the preceding day.
Confirm deposit-return arrangements separately before committing to a new closing date.
Losses to avoid
Use the ledger to catch an incorrect dispatch-based starting date, an assumption that moving out ends rent, or an unsupported holiday or partial-month calculation.
These differences can create additional rent or poorly timed moving funds.
Check housing, commercial coverage and the renewal type
Housing tacit renewal
Housing Lease Protection Act Article 6 provides for renewal on the same conditions when its requirements are satisfied, with a deemed two-year duration.
Under Article 6-2, the tenant may give termination notice and termination takes effect after three months from the landlord’s receipt.
First verify renewal itself, including Article 6(3) exceptions such as arrears reaching two rent installments or a significant breach of tenant obligations.
Commercial tacit renewal
Commercial Building Lease Protection Act Article 10(4) provides for a qualifying tacit renewal with a one-year duration; Article 10(5) provides for a tenant’s notice and three months after receipt.
The reference is Article 10(5), not Article 10-5.
Article 2 does not extend Article 10(4)–(5) to every lease above the converted-deposit coverage limit, so coverage must be checked first.
Statutory renewal demands and express renewal agreements are outside this calculator’s scope.
Even where a termination provision is applied to another renewal type, do not relabel the facts as tacit renewal.
Above-limit commercial leases under Civil Act Articles 635 and 639, a landlord’s notice, and termination for arrears need separate review.
What evidence belongs in each input?
Prior expiry and renewal evidence
Use the expiry immediately before the current tacit renewal, rather than reusing the original expiry from years earlier.
Compare the contract with any rejection or condition-change communications.
Mark the renewal facts as verified, assumed or unknown.
Receipt date and note
Enter when the landlord received the tenant’s termination notice.
A dispatch receipt alone does not automatically establish delivery.
Record the name of the delivery or acknowledgment evidence without personal details.
Civil Act Article 111 establishes receipt as the relevant event, while proving it in a dispute remains a separate question.
Billing cycle and settlement start
Verify the monthly rent principal and the day from which each rent month runs.
The settlement start is the first included day of this review interval.
If you exclude a prepaid period from the interval and also deduct the same payment, you double-count it; reconcile the interval and allocations together.
Zero versus missing
Enter zero if the absence of monthly rent is verified, as may be the case with a deposit-only housing lease.
An unknown blank amount remains pending.
No payment rows do not establish zero paid until you confirm that the complete payment history for this interval has been checked.
Verified evidence describes your input status.
It does not mean a court or authority has established renewal, notice validity or final liability.
Any assumptions used remain labeled in both the results and the saved review.
Three calendar months: the starting day and the effective date
- Normally exclude receipt day and start on the following day.
Use the Civil Act Article 157 exception only when commencement exactly at 00:00 is actually verified.
- Apply calendar months under Article 160, rather than adding 90 days.
Starting on the first day of a month produces the end of the third month.
For another starting day, use the day before its corresponding date in the final month; if that date does not exist, use the final day of that month.
- Check Saturdays and public holidays at the nominal end.
The period continues through the adjusted final day.
Under Article 159, its expiry at 24:00 is the same instant as 00:00 on the following date, which is how this calculator labels termination taking effect.
Receipt near month-end
Receipt on 2026-02-28, with that day excluded, starts the period on March 1 and produces a nominal end of May 31.
It is not May 28 obtained by simply adding three months to receipt.
Receipt on 2026-08-30 starts on August 31; there is no November 31, so the nominal end is November 30 and, without a holiday adjustment, the effective date is December 1 at 00:00.
The current renewal’s natural expiry is also displayed.
Notices received before the renewal starts or outside its entered cycle remain pending.
If the three-month period passes natural expiry, the tool requires separate review of expiry or further renewal rather than automatically choosing an earlier termination date.
Verify the end-date holiday calendar
The calculation assumes no different applicable provision or valid arrangement under Civil Act Article 155 and applies the Saturday/public-holiday adjustment in Article 161.
Saturdays and Sundays are automatic.
No complete public, substitute or temporary holiday calendar is preloaded, so check the end and consecutive dates yourself.
Before confirmation, the displayed adjusted end is a reference and the effective date remains pending.
A hypothetical consecutive-holiday comparison
If the nominal end is Saturday, 2026-10-17, the weekend moves the end to Monday, October 19.
Assuming no further public holiday, termination takes effect on October 20 at 00:00.
If October 19 is entered as an assumed public holiday, the end moves to October 20 and the effective date to October 21.
This added holiday is a fictional illustration, not a statement that October 19 was officially designated a holiday.
Enter genuine calendar dates separated by commas or whitespace.
Personal leave and an estate agent’s office closure are not public holidays for this input.
Recheck when the receipt date, the midnight exception or the holiday list changes.
Any different applicable agreement or legal exception requires separate review.
Rent formulas for complete and partial billing cycles
Complete cycle
Complete-cycle rent = monthly rent principal
A complete rent month uses the monthly amount whether its cycle has 28 or 31 days.
A billing day of 31 falls back to month-end when absent, then restores the original day in the next month.
Partial cycle
Partial rent = monthly rent × included days ÷ verified denominator
Choose actual days in that billing cycle or an agreed 30-day denominator.
Verify rounding down, half up or up to whole KRW per row, then add the row amounts.
A universal statutory 30-day proration rule is not assumed.
The first settlement date and adjusted period end are inclusive; the effective date is excluded.
Rent dependent on an unverified calendar remains pending.
Without an agreement for a partial cycle, that row and the complete total stay pending, while the known complete-cycle subtotal is shown separately.
The subtotal alone is not the final amount owed.
Verified monthly rent of zero also produces zero for partial periods.
Each amount and total is limited to KRW 1 trillion, with up to 36 billing cycles and 30 payment entries.
Management fees, commercial VAT, late interest, deposit deductions and offsets are not automatically added to this rent-principal ledger.
Step-by-step use
- Compare the contract and renewal communications, then choose housing or commercial tacit renewal.
For commercial premises, first verify converted-deposit coverage and other applicable scope conditions.
- Enter the immediately preceding expiry, receipt date and evidence status.
If only dispatch is known, establish receipt before treating a date as verified.
- Check the nominal and adjusted period ends and add any relevant consecutive public holidays before confirming the calendar.
Normally leave the midnight exception unchecked.
- Enter the first settlement date, monthly rent and billing day, with the proration denominator and rounding agreement.
Include only prepaid or other amounts allocated to rent in this interval.
- Compare planned handover and deposit return and resolve pending items.
Save the TXT review, print it or export the conditional effective date to a calendar, then prepare questions for the landlord.
The fictional example remains labeled even after edits.
Reset the form before starting a review based on actual contract evidence.
Worked example: KRW 620,000 monthly rent and October 16 at 00:00
Assume a housing contract expired on 2026-06-30 and a notice after tacit renewal was received on 2026-07-15.
The period starts July 16 and ends on Thursday, October 15, assuming the relevant calendar is checked and no additional public holiday applies.
The effective date is 2026-10-16 at 00:00.
The settlement begins August 1, with billing on the first, monthly rent of KRW 620,000, actual-cycle proration and rounding down.
Fictional rent ledger from August 2026 through the day before termination| Included dates | Days / cycle | Rent (KRW) |
|---|
| August 1–31 | 31 / 31 | 620,000 |
| September 1–30 | 30 / 30 | 620,000 |
| October 1–15 | 15 / 31 | 300,000 |
| Total rent | 76 days | 1,540,000 |
With KRW 500,000 already allocated to this interval’s rent principal, additional cash needed is KRW 1,040,000.
If handover means no use from October 1 at 00:00, the ledger contains 15 unused days with KRW 300,000 of assumed rent exposure.
That amount is already included in total rent; do not add it again.
Changing the proration agreement to unknown leaves a known complete-cycle subtotal of KRW 1,240,000, while the October row, complete total and balance remain pending.
With an agreed 30-day denominator instead, October rent is KRW 310,000 and total rent is KRW 1,550,000.
The agreement therefore changes the result.
Interpret payments, handover and deposit return separately
Additional cash and excess allocation
Additional cash is the positive difference between complete rent and all known allocated payments.
If payments exceed rent, an excess-allocation reference is shown separately.
It is not automatically a deposit refund or an offset against another obligation.
Check that multiple entries do not allocate the same payment twice.
Leaving earlier
The handover input assumes no actual use from 00:00 on that date.
Earlier delivery does not itself shorten the statutory notice period.
A new tenant’s occupation or a landlord’s separate rent waiver or early-termination agreement needs its own review.
Delivery after the effective date
Actual use after termination, delivery obligations and an unreturned deposit require separate consideration.
This ledger ends before the effective date and must not be interpreted as zero later liability.
The deposit-return plan is also not automatically converted into a guaranteed statutory payment date.
Practical scenarios and boundaries
- Before signing for the next home: use receipt and holiday evidence to review the existing rent budget, then separately check any gap between deposit return and the next closing payment.
- Reconciling the final rent request: compare complete and partial cycles, the day-count denominator and row rounding.
Separate arithmetic differences from disagreements about the contract.
- Helping a family member: mark evidence status first and record document names rather than personal information.
Keep original evidence separately and use pending items as questions for further advice.
The calculator does not determine renewal formation, notice wording or recipient authority, arrears exceptions, a landlord’s termination, damages or brokerage-fee responsibility.
Review any valid agreement for a different date and any overlap with natural expiry separately.
A displayed number or date does not replace receipt evidence or examination of the legal relationship.
Frequently asked questions
Do three months start when I send certified mail?
The relevant input is when the landlord received the notice.
Check dispatch evidence separately from delivery or acknowledgment evidence, and review disputed receipt independently.
Can I select a lease renewed by a statutory demand?
Do not change the factual renewal type to tacit renewal.
Renewal demands and express agreements are outside this calculator; check their applicable provisions and notice timing separately.
Does every commercial lease end after three months?
This review requires tacit renewal within Commercial Building Lease Protection Act Article 10(4)–(5) coverage.
The result is not automatically applied to leases above the converted-deposit limit.
Why is the effective date after the period end?
The period lasts through the adjusted final day.
Its 24:00 is the same instant as 00:00 on the next date, so the rent ledger includes the final day and excludes the effective date.
Can I use the date before checking holidays?
The nominal and adjusted ends are reference boundaries for checking the calendar.
The effective date and dependent rent calculations stay pending until consecutive relevant public holidays are verified.
Personal days off are excluded.
Does unknown proration mean zero rent?
An unknown partial row is pending, not zero.
Keep it separate from known complete-cycle rent and first verify the denominator and rounding agreement.
Does rent stop when I move out?
Planned handover alone does not reduce this ledger.
Assumed unused-time exposure is displayed separately within the total.
Review any effective early-termination or waiver agreement independently.
Will my deposit be returned on the exported calendar date?
The calendar event is a review reminder for a conditional termination date.
Agree the actual return date, handover procedure and payment time separately.
It is not a payment promise or guarantee.
Official sources and verified rule dates
Current-law searches and article details were checked directly with Korea’s National Law Information OPEN API on 2026-10-15.
The versions are Housing Lease Protection Act MST276291, effective 2026-01-02; Commercial Building Lease Protection Act MST279651, effective 2026-05-12; and Civil Act MST284415, effective 2026-03-17.
These are statute-version effective dates, not statements about when each article was first enacted.
Supported receipt dates run from 2026-01-02 for housing and 2026-05-12 for commercial premises, through 2026-12-31.
Dates extending into 2027 assume the verified 2026 rules continue.
Recheck changed laws, holiday designations, relevant decisions and actual agreements.
The proration denominator and rounding are verified or assumed contract terms rather than a universal statutory rent rate.
Save the review and agree the handover and return plan
Gather receipt evidence, check the period-end holiday boundary, and verify the final partial cycle and payment allocations.
Resolve pending rows before discussing termination, key delivery and deposit-return dates and times with the landlord.
Keep the conditional effective date in the review and calendar, and retain the actual return agreement separately.
