What does this minor construction and owner execution check cover?
Korea-based rules for 2026: the Framework Act on the Construction Industry and its Enforcement Decree.
Amounts are Korean won (KRW), and area is gross floor area in square meters (m²).
A labor-only quote can omit materials and freight paid by the owner, changing whether the work qualifies as minor construction.
Splitting the same work into several contracts does not create separate monetary allowances.
This tool distinguishes contractor registration from the route in which the building owner actually executes the work.
Evidence to prepare before signing
Collect all same-work contracts and amendments, market-price evidence for supplied materials, freight, the building register, design gross floor area and actual use information.
A low price or a worker’s experience does not replace verification of registration and actual execution qualifications.
Save the TXT aggregation for the registration authority or architect.
Aggregate split contracts, supplied materials and freight
Work estimate basis
Sum of same-work contract amounts + supplied materials at market value not already included + freight not already included
Decree Article 8(1)1 aggregates the estimated amounts when the same work is divided into two or more contracts.
Materials provided by the client, including the prime contractor in a subcontracting relationship, bring their market value and freight into the estimate.
Different payees or payment dates do not establish separate work by themselves.
Leave the basis unconfirmed when the same-work boundary remains unresolved.
Do not add materials or freight already included in the contracts a second time.
Enter zero only for an item confirmed absent; leave an unquoted item blank.
Use a verified tax-inclusive estimate basis: this tool does not add tax automatically.
The known subtotal can exclude unresolved amounts and must not be treated as the complete estimate.
General KRW 50 million and specialty KRW 15 million: strictly below
General construction
The estimate must be below KRW 50,000,000.
KRW 49,999,999 is below; KRW 50,000,000 is not.
Ordinary specialty construction
For a non-excluded specialty trade, the estimate must be below KRW 15,000,000.
KRW 14,999,999 is below; KRW 15,000,000 has no monetary exception.
Difference to boundary = threshold − estimate.
Zero means the boundary has been reached, and a negative amount means it has been exceeded.
For whole-KRW inputs, maximum addition remaining strictly below = max(0, threshold − 1 − estimate).
A zero maximum addition does not mean the present work qualifies: read the status as well.
Recheck both scope and totals when work is amended or added.
Excluded specialty trades and the equipment exception
Trades excluded from the specialty monetary exception
- Gas facility work
- Steel structure work
- Cableway installation
- Elevator installation
- Railway and track work
- Heating work
These trades are excluded by the proviso to Decree Article 8(1)2.
A price below KRW 15 million alone does not remove registration requirements.
Match the actual work to the applicable trade and business scope; the owner cannot choose general or specialty classification merely to obtain a higher threshold.
Decree Article 8(1)3 separately addresses equipment readily moved through assembly and disassembly when its manufacturer or supplier directly installs it.
Potential applicability or an unknown selection keeps the general monetary result pending.
This exception does not cover all equipment installation or every supplier’s work.
Check the minor-work exclusion before the 200 m² boundary
Article 41 decision order
Act Article 41 excludes minor construction under the proviso to Article 9(1).
If minor status is confirmed, area above 200 m² or a restricted use does not independently reapply this restriction.
Building permits, notifications and structural safety obligations still require separate review.
For building or major-repair work that is not minor, check gross floor area above 200 m² and restricted uses.
Exactly 200 m² is not above the boundary; 200.0001 m² is.
Do not substitute exclusive-use floor area or the area being repaired for building gross floor area.
Ordinary-use buildings such as a qualifying detached house at 200 m² or less have an owner-execution route for review, while contractor registration remains a separate question.
Uses requiring review even at 200 m² or less
Housing and welfare uses
Check collective housing, multi-occupancy houses, multi-household houses and official residences.
Decree Article 36(1) also covers detached-house-form home childcare, group homes, local child centers and elderly welfare facilities, excluding elderly welfare housing from that particular list.
Uses involving many people
Check schools, childcare, kindergartens, special education institutions, disability lifelong education, lifelong education facilities, academies, entertainment bars, lodging, hospitals, specified tourism facilities, multi-living facilities and offices.
Tourist-use facilities under Decree Article 36(2) include specialized and comprehensive recreation facilities and tourist performance venues, as well as tourist lodging.
Hospitals include general, Korean medicine and convalescent hospitals.
Use of part of a building can trigger this review.
A shop or office sign alone does not establish ordinary use; compare the register, actual use and authority’s interpretation.
Agricultural exceptions and actual owner execution
Decree Article 37(1) covers warehouses, storage facilities, workshops, compost sheds, barns, fish farms and similar buildings installed for agriculture, forestry, livestock or fisheries.
The owner’s occupation or the land category alone is insufficient: confirm the installation purpose and actual building use.
A confirmed exception can support the owner-execution route without removing a contractor’s separate registration requirement.
Distinguish owner execution from an unregistered contract
Actual execution by the building owner differs from a contract making another party responsible for completing the work.
An owner route for an ordinary building at 200 m² or less, or an agricultural exception, does not allow an unregistered contractor to undertake non-minor work.
Decree Article 37(3) has separate housing-developer conditions for registration, capital, technical capability, construction record and approval; this tool leaves that route pending review.
How to use the calculator
- Confirm the Act’s scope, general or specialty classification and actual trade.
Keep unresolved mixed-work or separate-law scope unknown.
- Enter each same-work contract, then materials and freight not included in those amounts.
Avoid counting an included item twice.
- Confirm the complete scope, removal of duplicates and tax-inclusive estimate basis.
A blank amount remains unknown rather than becoming zero.
- Compare activity, gross floor area, all uses and exception evidence.
Use the separate selections for confirmed ordinary repair or new facilities.
- Read contractor registration and owner execution separately and save the TXT.
Present the evidence to the authority or architect before deciding on the contract.
Fictional example: aggregation changes the result
Ordinary specialty work totaling KRW 15,000,000
Contracts of KRW 8,000,000 and KRW 4,000,000, supplied materials of KRW 2,000,000 and freight of KRW 1,000,000 total KRW 15,000,000.
Even without an excluded trade, equality means no minor-work monetary exception.
The boundary difference and maximum addition are both zero.
For an ordinary detached house at 200 m² with no other exception, owner execution remains available for review, but an unregistered proposed contractor makes the whole KRW 15,000,000 a work amount requiring review.
This amount is not damages or a fine.
A one-won difference and an area change
If actual verified freight is KRW 999,999, the total becomes KRW 14,999,999 and meets the monetary exception.
This is not advice to reduce an amount on paper.
At the original KRW 15,000,000, changing only the area to 201 m² without an exception requires a registered constructor.
At KRW 14,999,999, minor work remains excluded from Article 41 even for 201 m² or collective housing.
Practical scenarios for homes, shops and farm buildings
Owner purchases materials separately
Combine the work quote with material receipts or market-price evidence and check omitted freight paid by the owner.
First check whether each item is already in the contract.
Split contracts or changing uses
Review contracts divided by period or contractor as a whole when they concern the same work.
An academy, lodging or office use in a small building prevents deciding owner execution from area alone.
For a farm warehouse, retain evidence of installation purpose and Article 37 conditions.
Limits and cautions when interpreting results
Act Article 2(4) excludes electrical, communications, fire-protection and national-heritage repair work from this construction-law scope.
New sports, park, theme-park and other facilities under Article 41(2) require Decree Article 38 and facility-specific review; this tool leaves them pending.
Confirmed repair outside building or major repair can be outside that building restriction while still retaining its separate contractor-registration result.
Pending does not mean no obligation.
A zero estimate requires evidence review, and selecting registered does not certify the correct trade or absence of business suspension.
Verify actual execution qualifications under Article 16, the contracting party under Article 25, building permits, notifications, supervision, structural safety and separate-law duties before signing.
The tool does not establish illegality, contract validity, fines, damages or cost savings.
Frequently asked questions
Is exactly KRW 15 million minor specialty work?
No.
Even a non-excluded specialty trade must be strictly below KRW 15 million.
Equality has no monetary exception.
Can owner-purchased materials be removed?
Include their market value and freight.
Verify that costs already included in contracts are not counted twice.
Does splitting contracts increase the allowance?
Estimates for the same work are aggregated.
Ask the authority and keep the result pending if the same-work scope is unresolved.
Can I hire an unregistered contractor below 200 m²?
Owner execution and contractor registration are separate.
Check restricted uses, and verify registration and qualifications for non-minor work.
What if minor work involves collective housing or more than 200 m²?
Article 41 excludes minor construction.
Building permits, notifications, safety and separate-law duties still require review.
Are all buildings owned by farmers exempt?
No.
Verify agricultural, forestry, livestock or fishery installation purpose and building-use conditions under Decree Article 37(1).
Should I put zero for an item without a quote?
Leave unknown amounts blank.
Zero is for confirmed absent items; any unresolved amount keeps the complete monetary result pending.
Is the work amount requiring review a loss or fine?
No.
It is the confirmed total of work requiring registration when the proposed contractor was entered as unregistered.
Use it to organize evidence and reconsider the contracting party.
