Korean forced heirship protects a minimum inheritance portion even when the deceased made gifts or a will that favors another heir or a third party. This calculator estimates the reserved-share base, each heir's reserved share, shortfall, return targets, and limitation deadlines.

The English calculator keeps the Korean page's unit convention for estate inputs: amounts are entered in 10,000 KRW units. That preserves parity with the Korean pure function and avoids silently changing the legal model's numeric inputs.

Important Note

Reserved-share litigation is fact-intensive. Lifetime gifts, special benefits, contribution shares, gift timing, and whether a donee knew the gift would harm heirs can change the result.

Reserved-Share Base

  • The basis starts from positive estate assets such as real estate, financial assets, and other property.
  • Debts are subtracted from the estate base.
  • Testamentary bequests are tracked because they may be return targets.
  • Special-benefit gifts to heirs are included in the model.
  • Third-party gifts are generally included when made within one year before death or when made with knowledge that they would harm forced heirship.

Shortfall and Return Targets

Each heir's shortfall is calculated by comparing the reserved-share amount with the heir's special benefits and actual net inheritance. If the reserved share is infringed, the model allocates return targets among bequests and included gifts.

The practical order and allocation of return can be disputed, especially when several donees or legatees received benefits at different times.

Limitation Periods

  • The short period is 1 year from the date the heir knew of the inheritance opening and the returnable gift or bequest.
  • The long-stop period is 10 years from the opening of inheritance.
  • The calculator displays these deadlines from the death date for planning, but actual knowledge dates should be checked separately.

The Korean calculator's data model uses manwon units. The English UI keeps that unit to produce the same numeric results.
