What Is the Korea Divorce Pension Division Calculator?

This calculator estimates pension division after divorce in Korea. It compares public pension split amounts, retirement pension split amounts, eligibility conditions, receiving age, and claim timing. It is designed for cases involving National Pension, government employee pension, private school teacher pension, military pension, DB retirement pension, DC retirement pension, or IRP.

The model follows the Korean page. It reflects National Pension Act Article 64, the 2026 rule that the National Pension split can be checked with a 1-year minimum marriage period in this calculator, the 5-year minimum used for other public pensions, the 5-year claim deadline, and the 3-year advance claim window before pension receiving age.

Who Uses This Calculator?

  • Divorced or divorcing spouses checking divided pension eligibility in Korea.
  • People comparing monthly public pension division and one-time retirement pension division.
  • Spouses preparing settlement terms for pension split ratio.
  • Lawyers and mediators explaining the difference between National Pension, public-service pension, and retirement pension claims.
  • Applicants checking whether the claim deadline or receiving age may be an issue.

Public Pension Division

National Pension

National Pension division is a monthly divided pension claim based on the part of the former spouse's old-age pension attributable to the marriage period. The default split is generally 50%, unless the parties agree otherwise or the court determines a different ratio.

  • Legal basis: National Pension Act Article 64.
  • Marriage period used by this calculator: marriage years minus separation years.
  • Minimum marriage period in the calculator: 1 year for National Pension.
  • Default split ratio: 50% of the pension attributable to the marriage period.

Government, Private School, and Military Pensions

Other public pensions use a similar marriage-period attribution concept but have separate statutes and a 5-year minimum marriage period in this calculator. These pensions can be financially significant because the former spouse's monthly public pension may be higher than ordinary National Pension benefits.

  • Government Employees Pension: for civil servants.
  • Private School Teachers Pension: for covered private school personnel.
  • Military Pension: for covered military service.
  • Minimum marriage period: 5 years in the calculator.

Receiving Age and Claim Deadline

National Pension Receiving Age by Birth Year

Divided pension payment normally starts when the applicant reaches the relevant old-age pension receiving age. The calculator uses the receiving-age table embedded in the Korean logic.

Birth yearReceiving age
1952 or earlier60
1953-195661
1957-196062
1961-196463
1965-196864
1969 or later65

Deadline Rules Used

  • Claim deadline: 5 years from the time the divided pension right can be exercised.
  • Advance claim: may be checked within 3 years before receiving age.
  • Divorce date matters: the calculator checks elapsed time from divorce in the same way as the Korean logic.
  • Birth year matters: without a birth year, receiving-age status cannot be fully evaluated.

How Public Pension Split Is Calculated

1. Determine Effective Marriage Years

The calculator subtracts separation years from marriage years. This prevents separated periods from inflating the pension share.

2. Attribute the Former Spouse's Pension to the Marriage Period

The former spouse's expected monthly pension is multiplied by effective marriage years divided by total pension subscription or service years.

3. Apply the Split Ratio

The default ratio is 50%, but settlement or judgment can use another ratio. The calculator allows the ratio to be changed.

Monthly split = spouse monthly pension x effective marriage years / spouse total years x split ratio

Retirement Pension Division

DB Retirement Pension

For DB plans, the calculator estimates total retirement value from average monthly wage and total service years, then attributes a portion to the marriage service period.

DB split amount = average monthly wage x total service years x marriage service years / total service years x split ratio

DC Retirement Pension and IRP

For DC plans and IRP accounts, the calculator starts from the total account balance. It attributes the balance to the marriage accumulation period and then applies the split ratio.

DC or IRP split amount = total balance x marriage accumulation years / total accumulation years x split ratio

How to Use the Calculator

1. Enter Marriage, Separation, and Date Facts

Input the marriage period, separation period, birth year, divorce year, and divorce month.

2. Add Public Pensions

Enable National Pension or a public-service pension, then enter total service years, expected monthly pension, and split ratio.

3. Add Retirement Pension

Select DB, DC, or IRP and enter wage, service years, balance, and the marriage-period portion.

4. Review Monthly and Lump-Sum Results

Separate the recurring monthly public pension split from the retirement pension lump-sum split.

FAQ

Is pension division automatic at divorce?

No. Eligibility and claim timing must be checked. A settlement can also set a different split ratio or handle pension rights separately.

Does separation reduce the pension split?

The Korean calculator uses effective marriage years, meaning marriage years minus separation years, when attributing pension value.

What is the usual split ratio?

The default reference is 50%, but parties may agree on a different ratio and courts can determine a different ratio based on the case.

Are retirement pension and National Pension the same?

No. Public pensions are usually monthly divided pension claims, while DB/DC/IRP retirement pension division often functions as a property division amount.
