What Is the Korea Divorce Alimony Assessment Calculator?

This calculator estimates Korean divorce alimony from fault grounds, severity, marriage duration, children, economic status, mental damage, mutual fault, and litigation cost. It reuses the Korean page's 2026 civil-law calculation model.

The model starts with a base amount for the most serious fault ground, applies severity and adjustment rates, deducts mutual fault if selected, then produces a minimum, midpoint, and maximum estimate.

Important Note

Alimony is discretionary. Courts decide based on all facts, evidence, credibility, and case law, so the calculator should be used as a structured estimate only.

Base Amounts by Fault Ground

Fault groundBase range in the Korean model
InfidelityKRW 20M to KRW 50M, midpoint KRW 35M
Domestic violenceKRW 30M to KRW 100M, midpoint KRW 55M
Malicious abandonmentKRW 10M to KRW 30M, midpoint KRW 20M
Economic abuseKRW 15M to KRW 40M, midpoint KRW 27M
Emotional abuseKRW 10M to KRW 30M, midpoint KRW 20M
Other faultKRW 5M to KRW 20M, midpoint KRW 12M

Adjustment Factors

  • Severity multiplier: mild 0.7x, moderate 1.0x, severe 1.5x.
  • Marriage duration adjusts from -20% for under 3 years to +30% for 30 years or more.
  • Minor children add 5% for one child and 10% for two or more minor children; no children subtracts 5%.
  • Respondent income can subtract 10% below KRW 3M monthly or add 10% to 20% for higher income brackets.
  • Respondent assets of KRW 500M or more add a high-asset adjustment in the Korean model.
  • Serious mental damage adds 15%; critical damage adds 30%.

Mutual Fault and Litigation Cost

If mutual fault is selected, the calculator deducts the selected percentage from the raw alimony estimate. When litigation cost is included, it subtracts filing fee, service fee, lawyer retainer, success fee, and related modeled costs to show net receivable.

Limitation Period

  • The Korean constants use a 3-year limitation period for the modeled claim path.
  • An absolute 10-year limitation concept is also tracked in the data model.
  • Actual limitation analysis depends on divorce date, awareness date, and claim type.

FAQ

Why does domestic violence start higher than infidelity?

The Korean model assigns a higher base midpoint to violence because physical and psychological harm is often treated as more severe.

Can several fault grounds be combined?

The Korean model can apply compound-fault bonuses. The English UI exposes one primary ground in this batch for a stable, readable estimate.
