Manage both the action and execution-court proof after an objection
This calculator concerns Korean court auctions and the 2026 Korean procedural rules.
After disputing a distribution schedule, you need to check both the action filing and the submission of proof to the execution court that handles the distribution.
A receipt from the court hearing the action does not establish that the execution court has received the required evidence.
Enter the hearing date, your party status, how the objection was made and the opposing creditor’s enforcement title to identify the procedure requiring review.
The result is a planning checklist rather than a legal pleading or a determination of procedural validity.
Review filing dates and living expenses together
A delayed or deposited distribution can leave a household short of cash for living expenses and legal preparation.
Separate the disputed amount, court-confirmed held funds and your own confirmed immediate receipt so that money still unavailable is not treated as cash already in hand.
Keep the result with the court schedule, objection record and actual receipts when coordinating with family or counsel.
Party status and the enforcement title determine the procedural branch
A creditor objects to another creditor’s distribution
Civil Execution Act Article 151(3) addresses a creditor who attends the hearing and objects within the scope of their affected interest.
An unresolved objection follows the distribution-objection action branch under Article 154(1).
Tenant status alone does not establish participation eligibility: check any distribution demand, rights notification, affected amount and hearing record.
A debtor challenges a creditor without an enforceable authenticated title
Article 154(1) also covers the relevant debtor objection where the opposing creditor lacks an enforceable authenticated title, excluding the provisional-attachment creditor exception.
Under Article 151(2), a debtor may also object in writing after the draft distribution schedule becomes available and before the hearing ends.
Check when the writing was received rather than assuming that nonattendance means no objection was made.
A debtor challenges a creditor holding an enforceable authenticated title
Article 154(2) specifies the claim-objection action.
Article 154(3) additionally requires proof of filing and the certified stay order concerning that action at the execution court within the relevant period.
Applying for a stay does not establish receipt of the required certified order; an existing action also requires review of its type and relief sought.
Automatic branch selection is withheld for a debtor objection against a provisional-attachment creditor, owner-only status, unknown attendance or title, and a creditor’s writing without confirmed attendance.
If the objection was accepted or resolved by agreement, first check the revised schedule under Article 152.
For a mortgage-enforcement auction, confirm the application of Article 268 and the actual party status; this tool does not supply deadlines for public sales or special procedures.
Use actual court receipt dates for each document
- Hearing date and reference date
- Use the distribution hearing date in the court record.
The remaining-day count uses a separate reference date, so the fixed date in the synthetic example must not be mistaken for today.
- Action filing date
- Enter receipt by the court hearing the action.
A date after the reference date is treated as planned and does not establish completed filing.
- Proof receipt at the execution court
- Enter the execution-court receipt date, rather than the proof’s issue date or postal dispatch date.
Confirm the specific supporting documents and recipient with that court and retain its receipt.
- Certified stay-order receipt
- This additional date is checked in the claim-objection branch.
Distinguish the application date, the date you received a decision and the execution court’s receipt of the certified order.
Even when all required entered dates fall within the period, the calculator only checks the dates you supplied.
It does not certify action validity, the effectiveness of a stay or preservation of the objection.
An action or proof received before the hearing is marked for case-specific review.
Calculate one calendar week and adjust its endpoint
Counted start → raw endpoint → adjusted endpoint
- Civil Execution Act Article 23, Civil Procedure Act Article 170 and Civil Act Article 157 support excluding the hearing day and starting on the following day.
- Under Civil Act Articles 159 and 160, the raw one-week endpoint is the hearing date plus 7 calendar days.
- Under Civil Act Article 161, a Saturday or public-holiday endpoint moves to the next day, repeatedly if the next endpoint is also excluded.
Weekends and public holidays inside the period still count.
Do not replace one week with seven business days or subtract every day of a holiday interval.
A 2026-09-17 hearing has the raw endpoint 2026-09-24 and an adjusted endpoint of 2026-09-28 after Chuseok and Sunday.
A 2026-10-02 hearing reaches 2026-10-09, then moves past Hangeul Day and the weekend to 2026-10-12.
A 2026-06-01 hearing reaches 2026-06-08; the intervening election day and Memorial Day remain counted.
Year boundaries and filing hours
The built-in calendar covers 2026, including Labor Day, Constitution Day, the June 3 election and substitute holidays.
For a 2026-12-25 hearing, the raw 2027-01-01 endpoint lies outside that calendar; adding that public holiday and confirming the other-year calendar moves it to 2027-01-04.
Add newly designated temporary holidays and other-year holidays, but do not enter personal leave days.
An all-day reminder or a statutory end date does not establish court-counter hours: check the filing method, cutoff and completed receipt.
From the distribution schedule to a saved preparation record
- Gather the schedule and objection record. Confirm the hearing, opposing creditor, disputed part and whether the objection remains unresolved.
- Select your status and the opposing title. A tenant creditor and a debtor can follow different branches; an unknown authenticated title must not be treated as absent.
- Review the raw and adjusted endpoints. Check extra holidays, other-year coverage and any uncertainty about the applicable procedure promptly with the court.
- Record action filing and execution-court receipts separately. Keep intended dates as plans until the actual receipts are confirmed.
- Enter cash, confirmed receipt and quotes. Compare quoted expenses and the living shortfall during the assumed wait with a scenario in which all distribution is delayed.
- Save the TXT review and ICS date. Retain the checklist and receipts, and coordinate preparation dates with family or counsel.
Calendar saving is withheld when the procedure, checked rule window or endpoint calendar is unconfirmed.
A provisional date should prompt review, rather than be treated as permission to wait until that date.
Distinguish disputed funds, court-held money and your unreceived balance
Recorded objection amount
This is the amount being disputed in the record.
It is not guaranteed additional recovery and is not included as available cash or forecast income.
Court-confirmed held amount
Enter only what is confirmed in a court notice or record.
Article 160 covers multiple deposit grounds, and the money may concern another creditor’s distribution rather than your own unpaid balance.
Your schedule and immediate receipt
Your unreceived balance is your scheduled distribution less the amount confirmed immediately receivable.
Leave immediate receipt blank when unknown; a confirmed zero is a different fact.
Cash already available
Enter funds available independently of the receipt entered here.
If a receipt is already included in your bank balance, align the entries to avoid counting the same cash twice.
If the entered court-held amount exceeds the objection amount, a warning asks you to check other claims or grounds for deposit.
The tool does not trim the court-record amount to the objection amount or decide who may withdraw a deposit and when.
Preparation budget and cash-shortage formulas
Expenses to prepare for
F = filing fee + service cost + professional fee + other preparation costs
G = monthly living shortfall × waiting months
B = F + G
The monthly shortfall is what remains after ordinary income.
Keep the input basis consistent so that gross living expenses, regular income and available savings do not overlap.
Compare receipt assumptions
Full-delay shortage = max(0, B − available cash)
Confirmed-receipt shortage = max(0, B − available cash − confirmed immediate receipt)
When immediate receipt is unknown, the second comparison is withheld.
Review both the full-delay assumption and the confirmed-receipt assumption to assess preparation funds.
The objection amount and unreceived principal are not new litigation expenses and are not added to the preparation budget.
Enter quotes inclusive of applicable taxes and ancillary charges, avoiding duplicates in other costs.
Waiting months are a household scenario, not a statutory proceeding duration or a predicted judgment date.
Verify the dates and budget with a synthetic example
A creditor’s unresolved objection at a 2026-09-17 hearing
Counting starts on 2026-09-18, the raw endpoint is 2026-09-24 and the adjusted endpoint is 2026-09-28.
On the reference date 2026-09-18, the result shows 10 days remaining.
If the action is filed on 2026-09-21 and proof is received by the execution court on 2026-09-22, move the reference date to 2026-09-22 or later and check the actual receipts.
While the reference date remains 2026-09-18, those entries remain planned dates.
- Quoted expenses
- 100,000 + 120,000 + 1,100,000 + 80,000 = KRW 1,400,000
- Living shortfall
- KRW 800,000 × 3 months = KRW 2,400,000
- Preparation budget and full-delay shortage
- KRW 3,800,000 − KRW 1,000,000 available cash = KRW 2,800,000
- Shortage after KRW 2,000,000 confirmed immediate receipt
- 3,800,000 − 1,000,000 − 2,000,000 = KRW 800,000
With a scheduled distribution of KRW 10,000,000 and KRW 2,000,000 confirmed immediately receivable, your unreceived balance is KRW 8,000,000.
The KRW 15,000,000 objection and KRW 12,000,000 court-confirmed held amount are not added to this budget.
These figures and the three-month assumption are synthetic, rather than statutory fees, market averages or evidence of a payment date.
Practical situations for the review record
A tenant creditor disputes another claim
Confirm the opponent and scope in the record, then document action filing and proof at the execution court separately.
If immediate deposit recovery is unconfirmed, prepare moving and living expenses under the full-delay scenario first.
A debtor challenges an enforceable claim
Check the separate certified stay-order receipt in the claim-objection branch.
A pending application or a decision you received does not establish that the execution court received the required certified order.
Family members help with a parent’s auction case
Compare recollections with the schedule, objection record, action receipt and proof receipt.
Keep confirmation status and assumptions in the TXT record; use the calendar as a preparation aid.
Interpretation limits and precautions
- A date within the period does not establish participation eligibility, a valid objection, action admissibility or preservation of the objection.
- The checked rule window covers hearings from 2026-02-01 through 2026-12-31. Earlier cases and other years require applicable-law review; confirming holidays does not complete that review.
- Article 130 appeal procedures and appeal security for a sale-permission decision are separate from Article 154 distribution objections. Security for an action or stay is not automatically estimated.
- Zero under unconfirmed quotes does not mean free filing. Confirm filing, service, professional and other costs, including any waiver, with the relevant court or provider.
- A past endpoint compares entered dates. Seek prompt legal review with the case record and receipts for any withdrawal effects or other remedies.
- The tool does not decide priority, success probability, security, revised distribution amounts, legal pleadings or deposit-withdrawal dates.
A zero shortage does not establish that funds arrive before every actual payment.
If living expenses and procedural costs fall due on different dates, prepare a separate cash schedule and review the full-delay comparison.
Auction objection deadline and held-funds FAQ
Is filing the action enough after objecting?
Article 154 distinguishes action filing from proof submitted to the execution court, so confirm the required documents and the actual execution-court receipt as well.
Does one week mean seven business days?
It is a calendar week with an endpoint adjustment for Saturdays and public holidays; intervening holidays are not removed from the count.
Does debtor nonattendance necessarily mean there was no objection?
Article 151(2) permits the specified timely debtor writing, so check the court record for submission after draft availability and before the hearing ended.
Is applying for a stay alongside a claim-objection action enough?
Check proof of the action and execution-court submission of the certified stay order, distinguishing an application from completed receipt of the required order.
Why is the court-held amount different from the disputed amount?
The tool uses confirmed court records without inferring a deposit from the objection, and other deposit grounds or another creditor’s funds can make it different from your unreceived balance.
Should unreceived principal be added to legal costs?
Unreceived principal is not new expenditure; compare quoted costs plus the monthly living shortfall during the assumed wait with available cash and confirmed receipt.
Should I enter zero if immediate receipt is unknown?
Leave it blank to withhold the receipt-funded comparison, and enter zero only when no immediate receipt has actually been confirmed.
What if the date is past or crosses into 2027?
Check other-year holidays and applicable law, and promptly ask the execution court and counsel to review the case record and receipts if a missed deadline is suspected; a calendar file establishes neither compliance nor available remedies.
