A Korean death benefit claim trust: planning how family receives the money
A death benefit claim trust arranges for a trustee to manage insurance proceeds after the insured event and distribute money to family under agreed instructions.
It serves a different purpose from converting a living policyholder’s death benefit into retirement payments.
This calculator examines monthly support and one milestone payment for a minor child or another eligible family beneficiary.
A large insured amount does not establish that support will last until the intended age.
Setup costs, recurring management fees and a milestone payment can create an earlier shortfall.
Check each policy’s trust conditions first, then use the confirmed subtotal to review balances by age, the first shortfall and the maximum fixed monthly payment.
Korea-based planning note — 2026 rules, amounts in KRW
Official sources were checked on November 8, 2026.
A future assumed receipt month holds the verified current rules constant; it does not establish future eligibility or guaranteed investment returns.
Birth month and assumed receipt month support a monthly cash-flow model and do not predict a death date or life expectancy.
Policy conditions and the KRW 30,000,000 threshold
The Financial Services Commission announced the introduction of insurance benefit claim trusts effective November 12, 2024.
The current checks follow Article 109(3)(10) of the Enforcement Decree of the Financial Investment Services and Capital Markets Act and Article 4-92-3 of the Financial Investment Business Regulations.
Apply the threshold to each policy’s main general-death benefit before adding any eligible policies together.
Korean death benefit claim trust conditions for the policy, parties, beneficiaries and loans| Check | Condition represented by the inputs | Evidence to review |
|---|
| General-death benefit | At least KRW 30,000,000 per main policy | Main cover and rider breakdown |
| Parties | Policyholder = insured = settlor | Policy and trust application |
| Insurance beneficiary when entering the trust | Self, spouse, direct descendant or direct ascendant | Beneficiary record before setup |
| Trust beneficiary | Spouse, direct descendant or direct ascendant | Family relationship and payout instructions |
| Policy loan | No outstanding loan when entering the trust | Loan record and later-loan invalidity clause |
| Rights and contract terms | Designation/change rights preserved; loan clause confirmed | Trust terms and Commercial Act Article 733 |
Two policies with a main benefit of KRW 20,000,000 each do not pass the individual threshold merely because their combined benefit is KRW 40,000,000.
A KRW 20,000,000 general-death main benefit also cannot qualify by adding a KRW 100,000,000 accidental-death rider.
Accident- and disease-death rider benefits are excluded from this calculator’s eligible trust amount.
Reading conditions met, conditions failed and unconfirmed facts
Use the confirmed policy subtotal
Only policies that meet their individual conditions and the common trust conditions contribute to the modeled principal.
An unconfirmed policy remains pending while the calculation can show the confirmed subtotal from other policies.
That subtotal is not a final approval of all policies by a trustee.
Unknown does not mean zero
If the policy loan balance is unknown, retain its unconfirmed state instead of entering zero.
Unverified relationships and contract clauses do not pass automatically either.
Unconfirmed common conditions or no passing policy prevent a valid trust payout projection from being presented as established.
The insurance beneficiary before trust setup and the eventual trust beneficiary are separate checks.
Self is allowed in the first relationship check, but it does not make the deceased settlor an eligible recipient of subsequent family trust payments.
Confirm the actual procedure for changing the insurance beneficiary to the trustee and preserving designation/change rights with the insurer and trustee.
Repaying a loan does not automatically approve an earlier application; obtain updated evidence and ask for a new review.
What the support, milestone and fee inputs mean
Birth month and assumed receipt month
The model derives age in completed months when proceeds are assumed to enter the trust.
The payout horizon starts at that modeled receipt age, rather than assuming the child’s current age will remain the starting age in the future.
Day-level birthdays and actual payment dates are outside this monthly model.
Monthly support and milestone age
Choose one fixed monthly amount and one lump sum at a selected whole-year age.
A milestone amount of zero disables the milestone.
A positive milestone must fall between the starting month and the final target month.
Assumed return and annual management fee
The default 0% is a starting assumption, not a market forecast or a bank’s fee quote.
Enter a documented quote or an explicit scenario assumption.
There is no universal statutory fee rate; minimum fees, execution charges, product expenses and taxes require contract-specific review.
Setup fee and tax/other-cost reserve
Setup costs and money reserved for taxes or other expenses are deducted separately from the initial principal.
The reserve is a planning budget, not a calculated tax liability.
If these deductions exceed the principal, the model reports an initial funding gap instead of investing a negative balance.
Steps from policy evidence to a consultation plan
- Separate the main general-death benefit from excluded rider benefits in the policy documents.
Check up to three policies individually.
- Verify party identity, the pre-setup insurance beneficiary, loan balance and common trust clauses.
Leave missing facts unconfirmed and identify the evidence needed.
- Enter the assumed receipt month, target ending age, monthly support and the age/amount of the milestone payment.
- Include quoted setup and management costs and a reserve for unavailable tax money.
Also compare a lower-return scenario.
- Review the first shortfall and the maximum monthly amount, then save the TXT consultation plan.
Confirm payout wording, evidence requirements and actual payment dates with the insurer and trustee.
Monthly formulas and payment priority
Age in months = (receipt year − birth year) × 12 + receipt month − birth month
Payment months N = ending age × 12 − age in months
Initial available balance = confirmed principal − reserve − setup fee
Monthly return = (1 + annual return / 100)^(1/12) − 1
Monthly fee = balance after return × annual fee / 100 / 12
Each month applies return to the previous closing balance, deducts the management fee, pays any milestone due that month, then pays monthly support.
A milestone in month zero is paid before the first month’s return.
Actual payments cannot exceed available assets; unmet milestone and support amounts are recorded separately.
The schedule continues recording requests through the end even after a shortfall, so requested payments remain distinguishable from actual payments.
The maximum monthly payment is the largest whole-KRW fixed amount that can meet all requests under the same milestone, cost and horizon assumptions.
The calculation preserves the same return/fee/payment order.
If the milestone alone cannot be funded, the model shows that the plan is infeasible instead of claiming that a maximum of zero solves it.
The computed maximum assumes the selected constant return persists; it is neither a guaranteed contractual payment nor a recommended household budget.
Worked example: KRW 300 million from age 10 to age 30
Assume a fictional main general-death benefit of KRW 300,000,000 and all required input conditions met.
Birth month is November 2016 and assumed receipt month is November 2026, making the starting age 10.
The horizon to age 30 is 240 months.
Monthly support is KRW 1,000,000, a KRW 30,000,000 milestone is paid at age 20, and return, fees, setup costs and reserves are all zero.
Independent totals for the fictional KRW 300 million payout plan| Item | Amount or count |
|---|
| Confirmed principal | KRW 300,000,000 |
| Support: KRW 1,000,000 × 240 months | KRW 240,000,000 |
| Milestone at age 20 | KRW 30,000,000 |
| Closing balance at age 30 | KRW 30,000,000 |
| Maximum fixed monthly payment | KRW 1,125,000 |
After reserving the milestone, KRW 270,000,000 divided by 240 months gives KRW 1,125,000 per month.
At that monthly amount the final request is paid in full and the ending balance is exactly zero.
Adding management fees or changing the return to a negative value can reduce the feasible payment, so recalculate after changing the assumptions.
Depletion age and first payment shortfall are different
With KRW 30,000,000, 12 monthly payments of KRW 2,500,000 and no returns or costs, the final balance is exactly zero but nothing is unpaid.
Increasing monthly support to KRW 2,500,001 produces a KRW 12 shortfall in month 12.
Read the first zero-balance month separately from the first month that cannot meet a requested payment.
A milestone is paid before support, so the milestone month can leave insufficient funds for that month’s support.
Review the first shortfall, accumulated unmet amounts and the actual milestone payment alongside the ending balance.
The calculation does not automatically introduce another source of funds to repair a deficient plan.
Adjust support, the milestone or the target ending age and run the plan again.
Comparing an immediate lump sum and direct management
The immediately available lump sum is confirmed principal less the same reserve.
The trust’s initial investable amount also deducts setup costs.
The direct-management reference uses the same assumed return, support and milestone schedule with setup and management fees set to zero, isolating the modeled fee difference.
It assumes the lump sum is withdrawn on that schedule, rather than immediately spent in full.
A larger direct-management balance does not measure the value of administration and distribution services for a particular family.
Conversely, a trust does not automatically eliminate every dispute, guardianship issue or fraud risk.
Who may request payments, which documents are required, and how urgent or out-of-purpose requests are treated must be specified in the actual contract.
Family scenarios, return assumptions and fees
Support and education for a minor child
Set monthly support first and check whether an additional education milestone remains affordable.
The milestone age and amount are household assumptions, not statutory standards; consider the actual education plan and other resources.
Staged support for a young adult
A longer horizon can reduce the monthly amount supportable by the same principal.
Consider a separate reserve for urgent medical or housing needs and write down the intended payment priority for consultation.
The zero-return comparison removes assumed investment gains; it is not principal protection or a worst-loss scenario.
Zero may be more optimistic than an entered negative return.
Try a negative-return scenario and check whether the provider’s minimum fees, charging base, execution fees and product expenses differ from this simplified monthly fee model.
Inflation and automatic support increases are excluded, so a fixed KRW 1,000,000 should not be interpreted as maintaining the same purchasing power over decades.
Tax and contract limitations
A trust is a management and distribution arrangement and does not itself exempt insurance proceeds from Korean inheritance or gift tax.
Articles 8 and 9 of the Inheritance Tax and Gift Tax Act address insurance proceeds and trust property.
The actual premium payer and legal structure affect the analysis; neither automatic taxation nor automatic exemption should be assumed solely from using a trust.
The reserve field is not a tax calculation, and withholding on investment income is not calculated automatically.
Check who owes tax, when it falls due, and whether trust principal or income can be used for that payment before settling the distribution instructions.
Use the death benefit inheritance tax classification calculator for a separate review of premium funding and relationships, then confirm actual filing with an adviser.
The Enforcement Decree also requires provisions about policy loans and insurance beneficiary designation/change rights.
Confirm the clause invalidating the trust if a policy loan is taken after setup, and seek advice promptly if the policy lapses, is surrendered or otherwise changes status.
Results do not replace trustee acceptance, an insurer’s claim assessment or a court’s decision.
Frequently asked questions
Does a KRW 30,000,000 benefit guarantee acceptance?
Amount is only one condition.
Party identity, both beneficiary relationships, loans and contract clauses must also be checked, and the provider makes the actual acceptance decision.
Can accidental-death riders be included?
Only the main general-death benefit is used here.
Accident- and disease-death riders cannot be added to cross the KRW 30,000,000 threshold.
Are multiple policies assessed together?
Each main policy is checked first; only passing amounts are added.
Pending policies are excluded, so a confirmed subtotal is not the final value of all policies.
Is repaying a policy loan enough?
Check both the absence of a loan at setup and the clause invalidating the trust upon a later loan.
Ask the insurer and trustee to review updated records and required changes.
Is the maximum monthly payment guaranteed?
It is a computed limit under the entered return, fees, milestone and horizon.
Actual returns, minimum fees and additional expenses can change it; it is not a payment guarantee.
Does a zero ending balance mean the plan failed?
If the last request was fully paid, exact depletion produces no shortfall that month.
Read depletion and the first unmet payment as separate results.
Does the trust reduce inheritance tax?
This calculator does not estimate exemption or tax savings from using a trust.
The premium payer and trust structure require a separate tax review, and the reserve is not a computed liability.
Can several children be modeled at once?
The model covers one beneficiary, fixed monthly support and one milestone.
Do not allocate the same principal to several separate child scenarios without checking the actual total allocation and contract.
