What Is the Korea Illegal Debt Collection Response Calculator?

This calculator screens debt collection conduct under the Korean Act on Fair Debt Collection Practices. It checks the collector type, prohibited conduct, harm period, mental harm, and social harm, then classifies the matter into severe criminal, criminal, administrative-fine, or no-violation ranges.

The English calculator uses the same Korean judgment function as the Korean page. It does not multiply a debt amount by a generic rate; it matches selected conduct to statutory violation IDs, penalties, and civil damage ranges.

Important Note

A valid debt can still be collected illegally. Violence, threats, night contact between 21:00 and 08:00, repeated contact, disclosure to relatives or workplace contacts, and direct contact after attorney representation can trigger separate sanctions.

Prohibited Conduct Covered

Penalty and Damages Logic

  • The most serious conduct drives the top violation grade, while the calculator still counts all matched violations.
  • The Korean law effective date reflected in the source model is July 22, 2025.
  • Severe conduct can reach imprisonment up to 5 years or a fine up to KRW 50 million.
  • Other criminal conduct can fall into 3-year or 1-year imprisonment ranges, while fine-track conduct can create KRW 5 million to KRW 20 million administrative fine exposure.
  • When the collector is a business or collection agency, the civil-damages model reflects the statutory burden-shift concept for intentional or negligent unlawful collection.

Response Sequence

The Korean page emphasizes evidence first: call recordings, message captures with sender and time, visit logs, mailed notices, medical records, and witness records should be preserved chronologically. Recording a conversation that includes the victim is generally treated differently from recording third-party communications.

If an attorney or legal corporation is appointed as representative and proper written notice is sent, direct contact with the debtor can become a separate violation. The calculator surfaces that risk through the selected conduct and collector status rather than by a simple debt-size formula.

FAQ

Can a collector be sanctioned even if the debt is real?

Yes. The existence of a debt does not allow illegal collection methods. The method of collection is evaluated separately.

Why is night contact treated specially?

The Korean model treats 21:00 to 08:00 contact and repeated contact without just cause as prohibited conduct because of the intimidation and privacy impact.

Legal Use Notice

This English page translates and adapts the Korean calculator content for Korea-based estimates. The interactive calculator reuses the same Korean pure calculation function as the Korean page, so the numerical result is aligned with the Korean service. It is an estimation tool, not legal advice for a specific dispute.
