What Is Korea Adultery Consolation Money?

Adultery consolation money is a civil tort damages claim against the third party who interfered with a marriage. Even after adultery was decriminalized in 2015, civil damages against an affair partner remain available under Civil Act tort principles.

This calculator estimates the range from affair type, duration, knowledge of marriage, divorce status, marriage length, children, the affair partner's role and attitude, income, marital-breakdown contribution, evidence level, spouse settlement, repeated affair, costs, and limitation dates.

Important Note

A claim can fail or be reduced if the affair partner did not know about the marriage, the marriage had already broken down, or a spouse settlement is partially credited.

Legal Basis

  • Civil Act Article 750: tort liability for intentional or negligent unlawful acts.
  • Civil Act Article 751: compensation for non-property mental distress.
  • Civil Act Article 760: joint tortfeasor liability can connect the unfaithful spouse and the affair partner.
  • Civil Act Article 766: 3 years from knowledge of damage and tortfeasor, and 10 years from the tort.

Fourteen Practical Factors

  • Affair type, duration, and whether the affair partner knew the spouse was married.
  • Whether the marriage continued, separated, or ended in divorce.
  • Marriage duration, minor children, adult children, and household impact.
  • Affair partner aggressiveness, post-discovery attitude, income, and repeated misconduct.
  • Other causes of marital breakdown, evidence strength, and whether the spouse already paid a settlement.

Costs and Limitation Periods

  • The model estimates stamp duty, delivery fees, lawyer fees, investigator costs, total cost, and net receipt.
  • A 3-year limitation is calculated from discovery date and from divorce date when entered.
  • A spouse settlement does not automatically bar a separate claim against the affair partner, but it can affect the amount.

FAQ

Can I sue the affair partner without divorcing?

Yes. Korean civil practice allows a claim against the affair partner even if the marriage continues, though divorce can increase the damages estimate.

What evidence is strongest?

Direct evidence such as messages, photos, videos, accommodation records, admissions, and lawful call or location records is stronger than circumstantial suspicion.
