What does this Korean benefit collection calculator estimate?
This calculator organizes a repayment budget for industrial accident insurance benefits that have already been paid and are considered, or assumed for comparison, to be undue.
It separates fraudulent claims, specified reporting breaches and other incorrect payments rather than treating every work or income change as fraud.
It is intended for recipients, families and parties reviewing possible joint liability.
Start with the benefit type, affected period and undue amount in the payment decision or collection notice.
The total benefits you ever received are not automatically the collection base.
Use the resulting ledger to discuss reporting, corrections and payment arrangements with the Korea Workers’ Compensation and Welfare Service, or COMWEL.
Korea-based rules for 2026, using the Industrial Accident Compensation Insurance Act effective 2026-07-01.
Sources verified 2026-10-20; this model covers benefit periods from 2026-07-01 through 2026-12-31.
It does not decide whether conduct was fraudulent or predict criminal penalties.
Three collection categories under Article 84
Article 84(1) distinguishes false or fraudulent benefit claims, undue payments caused by failure to meet the reporting duties in Article 114(2)–(4), and other incorrect payments.
Having worked during treatment does not by itself establish the correct category.
Use the agency decision or mark the classification as assumed.
Article 84(1) collection categories, multipliers and evidence| Category | Multiplier | Evidence to review |
|---|
| Item 1: false or fraudulent means | 2× | Decision grounds, pre-investigation report and exemption decision |
| Item 2: specified reporting breach | 1× | Applicable Article 114(2)–(4) duty and undue payment |
| Item 3: other incorrect payment | 1× | Revoked or corrected decision and actual recovery |
A 2× collection means twice the undue benefit in total.
For KRW 1,000,000 in undue benefits, the starting ordinary collection is KRW 2,000,000: one base amount plus one additional amount.
It does not mean returning the original amount and adding twice that amount again.
The reporting-breach and incorrect-payment categories do not carry that additional collection.
Distinguish the three monetary inputs: B, H and P
Undue benefit B
The reviewed or assumed undue benefit for this decision and period.
A difference following a disability-status change also needs review of the recognized collection base.
Do not automatically enter the entire disability award or all medical benefits.
Actual agency recovery H
Only the money COMWEL actually received from the National Health Insurance Service or another relevant payer under Article 90(2).
This settles recipient medical benefits and cannot offset absence, disability or pension rows.
A pending claim, your health-insurance contributions and your personal medical bills are different items.
Credited repayment P
Money already credited by COMWEL against this same collection debt.
Verify its date and allocation with agency records.
Do not enter an Article 90(2) recovery again as a repayment credit.
Confirmed, assumed or unknown
Confirmed means you checked the type, amounts and credits against evidence or COMWEL.
Assumed values are comparison inputs.
Unknown evidence or classification withholds the full total rather than counting the row as zero; record the evidence date and basis note for later review.
The ledger supports up to 20 benefit-period rows.
Different benefits can share a period, but the same undue benefit must not appear twice.
A benefit period or evidence date after the reference date, or a period outside this model, leaves the complete total pending.
Any calculable subtotal remains a partial reference only.
Collection and remaining-balance formulas
Ordinary collection = M × B − H
Ordinary remaining = max(0, ordinary collection − P)
Collection if exemption is granted = B − H
Remaining if exemption is granted = max(0, B − H − P)
M = 2 for fraud; M = 1 for reporting breaches and other incorrect payments
The final sentence of Article 84(1) excludes money actually recovered under Article 90(2).
This is not limited to the incorrect-payment category.
For every category, the calculator applies the multiplier first and subtracts H once afterward; it does not deduct H from B and double the difference.
Until exemption approval is confirmed, the suggested budget remains the ordinary remaining amount.
Group only benefits covered by the same investigation, report and exemption decision; compare partial approvals in separate ledgers.
The conditional reduction compares the two remaining balances, so it can be smaller than B when substantial repayments have already been credited.
If an approved exemption leaves repayments above the revised collection, excess credit appears separately and is not presented as an approved refund.
When can a voluntary-report exemption be compared?
Article 84(4) allows COMWEL to exempt the amount above the benefit itself when the fraudulent claim is voluntarily reported before an investigation starts.
The exemption is discretionary, not guaranteed by submitting a report.
The provision also includes parties jointly liable under Article 84(2), but their actual approval and scope still require review.
Before investigation, report planned or submitted, decision unknown
The lower amount is a conditional comparison assuming an exemption is granted.
The budget remains the ordinary remaining amount.
A planned report is neither a completed filing nor an exemption approval.
Report submitted before investigation and exemption approved
The fraud rows use the remaining balance after the approved exemption.
Selecting approval together with an investigation already started, an unknown investigation time, or no submitted report creates an input conflict.
Investigation started, timing unknown, no report, or exemption denied
No voluntary-report exemption comparison is shown for fraud rows; budget the ordinary collection.
This does not mean reporting or providing evidence is unnecessary.
Ask the relevant COMWEL branch about the procedure and documents for your case.
How to use the calculator and prepare evidence
- Gather decisions and payment records. Identify the benefit, affected period and undue base; prepare work-day wages and disability or entitlement changes.
- Check investigation and reporting status. Confirm when investigation began and retain submission evidence; leave exemption unconfirmed until the agency decides.
- Enter separate benefit periods. Select each classification, evidence status and date; note the sources for B, H and P.
Do not classify every worked day as fraud automatically.
- Resolve pending rows first. A subtotal of calculable rows is not the complete repayment budget.
Check dates, missing information and duplicated credits.
- Save the review and contact COMWEL. TXT files and printouts are your comparison records, not submitted reports.
Ask separately whether instalments are permitted and confirm payment dates, allocation and conditions.
Worked example: KRW 1 million with recovery and repayment
These are hypothetical comparisons for the same recipient medical-benefit case.
Assume B=1,000,000, H=200,000 and P=100,000, all in KRW, with a planned or submitted voluntary report before investigation and no exemption decision yet.
Hypothetical collection and remaining balances by classification, in KRW| Scenario | Before repayment, KRW | Remaining, KRW |
|---|
| Fraud, ordinary collection | 1,800,000 | 1,700,000 |
| Fraud, exemption granted assumption | 800,000 | 700,000 |
| Reporting breach or other incorrect payment | 800,000 | 700,000 |
The fraud-row conditional balance is KRW 700,000, but the budget remains KRW 1,700,000 until approval.
After approval is confirmed, it becomes KRW 700,000.
The other two classifications have no additional collection, so their voluntary-report reduction is zero.
When repayments are already substantial
With the same B and H, P=900,000 and an approved exemption, revised collection is KRW 800,000 and remaining collection is zero.
The KRW 100,000 excess credit needs agency review and is not automatically refundable.
If repayments exceed even the ordinary collection, check whether the credit belongs to another debt or was duplicated.
Partial absence benefits: the 80% formula and minimum-wage proviso
Article 53(1) generally permits 80% of the difference between average daily wage and wages for a day worked during treatment or renewed treatment.
Decree Article 49 requires specified work and a medical opinion that working will not delay healing or worsen the condition.
Under Decree Article 50, an application is required and COMWEL determines whether to pay.
General formula example
A=100,000, W=40,000 and D=10 days produce a daily reference of KRW 48,000 and total entitlement reference of KRW 480,000.
If KRW 700,000 in absence benefits was already paid for those days, the reference difference is KRW 220,000.
Minimum-based daily benefit proviso
Where Articles 54(2) or 56(2) make the minimum wage amount the daily benefit, subtract work-day wages from the verified daily benefit instead.
L=82,560, W=40,000 and D=10 days produce KRW 425,600; against KRW 700,000 already paid, the difference is KRW 274,400.
L is not the hourly minimum wage: it is the applicable daily benefit after verification of the proviso and any older-worker adjustment.
The initial KRW 82,560 illustration is not automatically applied to everyone.
If work-day wages meet or exceed the applicable base, the helper shows zero entitlement.
Intermediate daily amounts remain unrounded; displayed totals round to whole KRW, while actual agency rounding and recognized days need separate confirmation.
An estimated partial benefit never automatically reduces the undue-benefit ledger.
You may add a correction row only after explicitly confirming both the conditions and COMWEL acceptance of the difference as the collection base; then verify the actual period and collection classification.
This does not guarantee retroactive correction or a reduced fraud collection base.
Is employer or medical-institution joint liability an extra charge?
Article 84(2) provides joint liability where a policyholder, accident-insurance medical institution or vocational-training institution caused the fraudulent benefit payment through a false report, diagnosis or certification.
Being the employer or issuing a diagnosis alone is not the test.
Select a party only after reviewing the causal connection and applicable decision.
The joint-exposure figure concerns the same debt and must not be added to the recipient budget.
If KRW 1,700,000 remaining is jointly owed, it does not become two separate KRW 1,700,000 charges totalling KRW 3,400,000.
Unknown joint-liability conditions leave joint exposure pending; actual notice recipients, scope and internal reimbursement claims need separate review.
A provider or pharmacy reclaiming its own incorrectly billed medical or drug fees falls under Article 84(3), outside this recipient ledger.
Do not enter those amounts, or a surcharge substitution under Article 44, as the medical-institution joint-liability input.
Practical scenarios and limits
A recipient worked for several days during treatment
List dates, wages per worked day and absence benefits already paid.
Ask about partial-absence conditions and possible corrections.
Do not assume the 1× reporting-breach category merely because work or income was omitted; confirm the legal grounds and affected period.
A family discovers a pension entitlement change
Review Act Article 114 and Decree Article 114 for pension-payment information and changes to entitlement, separating the actual change date and subsequent payments.
Act Article 114(4) requires the responsible person to report a recipient’s death within one month, but this calculator does not generate reporting deadlines.
A family needs a repayment budget
Save the ordinary budget using verified credits alongside the conditional approved-exemption balance.
Agree family contributions or discuss instalments only after checking the actual notice and due date.
Avoid allocating household cash on the assumption that an unapproved lower amount is already final.
- Criminal penalties, fines, late charges, seizure costs, instalment interest and limitation periods are outside the results.
- Benefits before 2026-07-01, rules for 2027 onward and providers’ own fee recovery need separate review.
- Input amounts and notes are not sent to the server; manage the saved TXT and printed copies yourself.
- Checklist and contact-completion selections are personal preparation records, not filings, payments or exemption decisions.
Frequently asked questions
Does KRW 1 million in fraudulent benefits mean repaying KRW 3 million?
No.
The ordinary 2× collection starts at KRW 2 million in total.
Actual recovery and credited repayment reduce the applicable amount.
Does voluntary reporting immediately reduce the multiplier to 1×?
No.
The report must precede investigation and COMWEL must decide to grant the exemption.
A planned or submitted report alone does not confirm approval; budget the ordinary remaining balance.
Is every unreported work day a reporting-breach case?
No automatic classification is possible.
Article 84(1), item 2 concerns undue payments caused by failure to perform duties in Article 114(2)–(4).
Check the specific duty and decision grounds.
When is health-insurance recovery deducted?
Amounts actually received by COMWEL under Article 90(2) are subtracted after the multiplier.
Pending claims and personal medical bills do not belong in H.
Can I subtract an estimated partial absence benefit?
An estimate alone is insufficient.
Verify the conditions, application and payment decision, and agency acceptance of the correction as the collection base before using the difference in the ledger.
Should I add employer joint liability to the recipient amount?
No.
It concerns the same debt.
Check the actual joint-liability requirements, notice scope and internal sharing separately.
Can I use the subtotal while one row remains unknown?
The subtotal covers only calculable rows.
It is not the complete repayment budget and does not treat unknown rows as zero; resolve their pending reasons first.
Does saving the review submit a report to COMWEL?
No.
TXT, printing and checklists are preparation tools.
Submit reports and correction applications separately and discuss instalments with COMWEL.
