Surcharge and levy

The real-name real estate system started in 1995 and title trust is generally prohibited. The Korean calculator estimates the surcharge, compliance levy, tax, registration cost, lawyer fee, and criminal risk of converting title back to the real owner.

Surcharge rates by elapsed violation period are 5 percent for up to 1 year, 10 percent for more than 1 year and up to 2 years, and 15 percent for more than 2 years. Additional property-value rates are 10 percent above KRW 500 million and 15 percent above KRW 3 billion, capped at a 30 percent final surcharge rate.

Conversion method and tax

Trust termination can avoid acquisition tax in the Korean source when it is treated as ownership restoration, while sale and gift forms can trigger acquisition tax and local surtaxes. Gift form or tax-evasion purpose can also trigger gift tax.

Gift tax uses progressive 10 to 50 percent brackets with a basic KRW 10 million exemption in the title-trust conversion source. Acquisition tax rates differ by sale or gift method and property type.

Registration and criminal risk

Registration cost includes application fee, stamp tax, and National Housing Bond discount cost. The source uses a KRW 15,000 registration application fee and KRW 15,000 stamp tax, plus region and property-type bond rates.

The criminal-risk output preserves trustor penalty and trustee penalty text from the Korean source, with a 7-year trustor limitation period and a 5-year trustee reference in the constants. Exceptions such as lawful trust, religious body structure, or spouse title trust require separate legal review.
