Korea Public Property Rent and Unauthorized Use Compensation Ledger

Build year-specific rent and 120% compensation entries, reconcile actual notices and allocated payments, and compare an assumed first non-occupied date.

A Korea 2026 ledger for ordinary public surface-land property. Split one parcel’s use at fiscal-year, lease/unauthorized-use and value-change boundaries.

Leave unknown amounts blank. Enter zero only for confirmed no charge or no payment. Totals cover entered periods only.

1. Property and scope

The national general 5% and residential 2% references are conditional minimums. Enter an official rate after checking the use and any temporary notice.

2. Annual and use-period entries

Both start and end dates are included. Use a new row from January 1 or the day after lease expiry. Even a one-day overlap withholds totals.

Period 1

Unknown

Compensation is the full 120%, applied once. Do not carry lawful-rent relief or annual increase adjustments into it. For bids, crop-income caps or special rules, use an authority-verified compensation annual basis or reconcile only the actual notice budget.

The notice total includes taxes and interest for this row’s period. Do not repeat one notice or payment across rows. Extras are not added to the notice total again.

  • Enter valid start and end dates in order, within 2000–2100.
  • Enter the purpose, evidence status and reference; confirmed evidence also needs a valid basis date.
  • Enter positive annual price, area, public charging share and rate, or the annual basis amount.
  • Confirm the day-count denominator and rounding rule with the authority.
  • Enter confirmed extra taxes or interest, or zero if confirmed not charged.
  • Confirm payments allocated to this row. Enter zero if nothing has been paid.

3. Hypothetical return-date comparison

Compare principal only, assuming unauthorized occupation stops from this date. Lawful lease periods remain unchanged. Existing notices, taxes, interest, payments and refunds are not revised.

Review Korean public-land rent and compensation by period

If you use land owned by the Korean national government or a local authority, distinguish lawful lease rent from compensation for unauthorized occupation.
Continuous physical use does not necessarily mean one continuous charging category: the day after a lease expires may begin a different category.
This calculator organizes year-specific assessed land prices, official annual rates, occupied area and the public ownership share into a period ledger.
Compare the model with actual notices and allocated payments, then examine a hypothetical earlier return date to understand the principal associated with further occupation.
This is a Korea-specific review tool using a 2026 legal snapshot, not a decision on lawful possession, cancellation of a notice or permission to continue using land.

When families organize land used for many years, recollections of the contract dates may differ from the documents, or an old payment may be mistaken for payment of a later period.
Marking year and use-category boundaries before entering amounts makes missing evidence easier to identify.
The Korean and English interfaces use the same pure calculation functions, amounts in KRW, and evidence states.

Four things the ledger helps you check

Separate annual assessment bases

Officially assessed land prices and authority valuations can change each year.
Keep each year’s supporting worksheet in its own row rather than extending one current price across several years.

Distinguish rent and unauthorized use

The model applies 100% of the basis to lawful lease periods and 120% to unauthorized periods.
Review the expiry boundary so the last lease day and first unauthorized day do not overlap.

Reconcile notices and payments

An actual notice total takes priority for payment budgeting.
Keep the model-to-notice difference visible so you can ask whether taxes, interest or a different assessment basis explain it.

Compare an assumed return date

Enter the first non-occupied day after completed return to compare principal with no unauthorized occupation from that day.
The comparison does not establish a reduction of an existing notice or a refund.

What the inputs mean and which records to prepare

Ownership, purpose and occupied area

Select national ordinary property or local-government ordinary property.
Privately co-owned land is not local public property merely because several people own it.
Confirm the actual residential, agricultural, commercial or other use and enter the area charged, rather than automatically using the whole parcel.
The public charging share is the ownership fraction charged by the public owner; it is not the user’s private ownership share.

Annual price, official rate and evidence date

Enter the KRW/m² price used in the assessment for that year.
Do not substitute a recent transaction price or an asking price.
Check the annual rate against the agreement, local ordinance or authority worksheet, and retain the reference and basis date.
A confirmed status is your description of the evidence; the calculator does not authenticate documents or approve their legal effect.

Direct annual basis amount

Bidding, crop-income caps, relief and annual adjustment can make a simple price-times-rate calculation incomplete.
For a lawful lease, enter the authority’s final annual rent after applicable relief and adjustment; for unauthorized use, enter the compensation-specific annual basis BEFORE multiplying by 120%.
A direct annual amount already covers the relevant area and public share: do not multiply by area, share or relief again.
An evidenced exemption may be zero, but an unknown amount should remain blank.

Notice total, extras and payments

Enter confirmed extra taxes or interest, using zero only when no extra charge is confirmed.
The actual notice total is the final payable amount allocated to this row, including its applicable extras.
Extras are not added to that notice total a second time.
For one notice covering multiple years, obtain its annual allocation before entering it in separate rows.
For payments, identify the notice and period to which the authority allocated the money, rather than relying only on the payment date.

Read the Korean 2026 rate rules in context

National property: conditional minimum rates

Article 29(1) of the Enforcement Decree of the State Property Act sets a general annual minimum of 5% of the property value.
Qualifying direct agricultural and livestock uses have a 1% minimum, residential use a 2% minimum, and qualifying basic-livelihood-beneficiary residential use a 1% minimum.
Other conditional references include 2.5% for administrative purposes, 4% for public-official welfare and 3% for qualifying small-business uses.
These are not automatic rates for every user: direct use, industry classification, temporary notices and other conditions must be checked.

Local public property: check the ordinance

Article 31 of the Enforcement Decree of the Public Property and Commodity Management Act delegates ordinary-property rental rates to local ordinances within a range of at least 1% of the assessed property value annually.
The national general 5% reference cannot be applied automatically to all local property.
Rates can differ by use and qualifying support even within one locality, so verify the applicable ordinance and actual assessment.

120% compensation and no ordinary annual adjustment

State Property Act Article 72 and Public Property and Commodity Management Act Article 81 set compensation at 120% of the applicable usage fee or rent basis.
120% is the entire compensation amount, not a charge of only 20%, and not rent plus another 120% totaling 220%.
State Property Act Article 72(3) and Local Act Article 81(3) exclude the statutory ordinary annual usage-fee or rent adjustment from compensation.
Do not automatically carry a lawful lease’s relief or annual increase limitation into an unauthorized-use row.

Formulas, daily fractions and rounding

Calculation sequence

  1. Assessed charging value = annual KRW/m² price × actual area m² × public charging share% ÷ 100
  2. Annual basis = assessed charging value × official annual rate% ÷ 100, or the directly entered annual amount
  3. Estimated lawful-rent principal = annual basis × inclusive days ÷ confirmed daily denominator
  4. Estimated unauthorized-use principal = annual basis × inclusive days ÷ confirmed daily denominator × 1.2
  5. Round down the final principal to the confirmed unit, then add confirmed extras for the estimated total

365 or 366 is an evidence-based selection

A rule allowing monthly or daily proration does not by itself establish one universal denominator for every authority.
Select either the actual year length of 365/366 or a fixed 365 only after checking the applicable worksheet or agreement.
For a leap-year period such as 2024, the selection changes the result.
For monthly, hourly or a different rounding method, reconcile the actual notice budget instead of treating this daily model as the legal calculation.

The KRW 1, 10 or 100 rounding unit is also an authority-confirmed input, not a nationwide default.
For compensation, rounding occurs after the period fraction and 120% multiplier, rather than rounding ordinary rent first.
Arbitrarily dividing one assessment into extra rows can change the number of rounding operations and create small differences.
Use the actual fiscal-year and assessment boundaries.

Move from documents to a reviewable ledger

  1. Identify the property and authority: confirm national or local ownership, ordinary-property status and surface-land scope, then record the parcel and managing office.
  2. Mark the period boundaries: both start and end dates are included.
Split at December 31 / January 1, lease expiry / the following day, and any change in assessed value or use category.
  3. Enter the annual evidence: use the annual price, area, public share and rate, or a direct annual basis, with the purpose, reference and basis date.
Mark assumptions separately from confirmed evidence.
  4. Allocate notices and payments once: enter each row’s actual notice and payments without duplicating a multi-year notice.
Without an actual notice, the estimated total supports the model budget only when the necessary evidence and extras are complete.
  5. Review pending items and contact the authority: resolve unknown values and overlaps, then save TXT or print the review ledger.
A partial subtotal does not establish a complete total while rows remain pending.

Worked example: 181 lease days and 184 unauthorized days

For a fictional 2026 case, KRW 1,000,000/m² × 20 m² × 50% public share × an assumed 5% annual rate produces an annual basis of KRW 500,000.
Assume a confirmed denominator of 365, rounding down to KRW 1, and zero extras.
The 5% rate is an example, not a recommendation for an actual case.

Entered-row total365 days550,410557,945300,000257,945

Assumed return date

If 2026-10-01 is the first non-occupied day, unauthorized occupation becomes 92 days and its principal becomes KRW 151,232.
With the unchanged lawful-rent principal, the revised principal total is KRW 399,177, a difference of KRW 151,233 from the original principal.
The actual KRW 310,000 notice and payment budget are not revised by this assumption.

Leap-year denominator comparison

For all 366 days of 2024 and an annual basis of KRW 500,000, compensation with an actual-year denominator of 366 is KRW 600,000.
A confirmed fixed-365 denominator produces KRW 601,643; rounding down to KRW 100 produces KRW 601,600.
The authority’s evidence determines which method applies.

Interpret partial totals, outstanding amounts and excess payments

Pending does not mean zero

Unknown evidence status or missing essential values and dates withholds the legal model.
The calculator shows available subtotals while withholding a full budget if any required row is incomplete.
An unknown payment is different from a confirmed payment of zero.
The supported money limit is KRW 1 trillion per amount and total, with 1–30 period rows.

Notice priority and reconciliation differences

A confirmed actual notice can independently support accounting even when the price/rate model is pending.
Invalid dates, cross-year rows and overlapping periods still withhold row budgets to prevent duplicate accounting.
The example’s estimate-minus-notice difference of KRW −7,535 is a question to investigate, not proof of an unlawful assessment or a refund entitlement.

No automatic offset across periods

Outstanding per row is the positive part of budget minus payments allocated to that row.
An excess payment in one row is not automatically applied against another row’s debt.
Confirm the authority’s actual appropriation, offset or refund before changing allocations.
Even complete entered rows do not cover omitted periods, other parcels or unentered notices.

Practical situations for using the ledger

Family land used after a lease expired

Compare the written expiry date, actual end of use and the occupation period stated in the notice.
Start a new row on the following day to isolate a period for which no renewal is documented.

One notice covering several years

A single notice can contain different annual values and day counts.
Request its detailed assessment, enter separate years and ask which historical rates and rules were applied.
Do not assume today’s rule automatically applies retrospectively.

Using part of a jointly owned parcel

Verify occupied area and the public owner’s share separately.
If the authority supplies an annual basis already reflecting the share, use direct annual input to avoid reducing it by the share twice.

Preparing return arrangements and cash

The planned return date is only a comparison of stopping further occupation.
The notice’s payment deadline and the authority’s actual handover procedure remain separate matters.
Confirm both schedules and prepare the cash shown by the notice-priority budget.

Exceptions and limits requiring separate confirmation

  • Statutory non-collection exceptions, including certain acquisitions for substantial consideration in reliance on public ownership records, require factual and authority review.
The tool does not grant an exemption.
  • Local Decree Article 81(6) can exclude the period from notice to payment only when timely payment and correction before payment satisfy its conditions.
A return date alone does not establish this exception, and the calculator does not apply it automatically.
  • National Decree Article 71(3) and Local Decree Article 81(1) allow authority-approved installments over up to 3 years with interest where compensation exceeds KRW 500,000.
An outstanding amount in this ledger is not an installment approval, and the calculator does not compute installment interest or deadlines.
  • Airspace, underground space, intellectual property, buildings, administrative-property special rules, automatic appraisal, limitation periods, appeal deadlines and eligibility review are outside scope.
Use actual confirmed notice totals for accounting when the model does not fit.
  • Dates within 2000–2100 can be entered, but the calculator does not reconstruct historical law or predict future ordinances.
Distinguish a frozen-rule assumption from evidence actually checked for that year.

Frequently asked questions

Is compensation only 20% more than ordinary rent?

120% of the applicable basis is the entire compensation amount.
Do not add lawful rent and a separate compensation amount for the same modeled period: this ledger multiplies that row’s basis by 1.2 once.

Can I use the national general 5% rate for local property?

Check the local ordinance and actual use category.
Article 31’s delegation within an annual range of at least 1% does not mean a nationwide fixed rate of either 1% or 5%.

Can one row cover a multi-year contract?

Split it by fiscal year using each year’s assessed value and official rate.
Also split when lawful lease changes to unauthorized use or the value or purpose changes.
Even a one-day overlap with another row withholds complete totals.

Should I choose 365 or 366 days?

Use the denominator verified in the authority’s worksheet, agreement or applicable ordinance.
A leap year does not automatically establish 366 as a universal legal rule.
For a monthly or other method, use the actual notice budget.

Does returning the land reduce an existing notice?

The return comparison only models the absence of further unauthorized occupation.
It does not amend an existing notice.
Ask the authority separately about the actual notice, payment and correction conditions for Local Decree Article 81(6) or other statutory exceptions.

What if the notice differs from the calculation?

Give the actual notice priority for the payment budget and ask the authority to explain the difference.
Bidding bases, area, dates, taxes, interest or exceptions may differ.
A numerical difference alone does not establish illegality.

Will an old excess payment automatically reduce another year’s debt?

No automatic cross-row offset is made.
Use the authority’s actual payment allocation before assigning money to a period.
If allocated payments are unknown, leave the field blank and keep outstanding amounts pending.

Does paying compensation authorize continued occupation?

Payment does not replace a lease agreement or permission.
Ask the authority whether lawful continued use is available and which procedure applies.
If return is required, confirm the actual handover and end-of-occupation dates separately.

Save a ledger and ask the managing authority to reconcile it

Start with dates and annual values supported by the lease and assessment worksheets.
Keep missing evidence marked as unknown.
TXT and printed ledgers preserve input references, pending items, actual notices and return-date assumptions so your family and the authority can review the same facts.
