Korea Urban Facility Land Purchase Claim & Lapse Calculator

Compare ten-year purchase-claim eligibility, twenty-year lapse reference dates, actual-notice purchase schedules, release applications and optional bond-payment scenarios under Korean rules verified in 2026.

Korean law, 2026 · document review only

Confirm actual implementation, authorization or equivalent procedures, exceptions, the original notice and ownership. Do not treat an unverified result as a vested right.

For ordinary facilities notified before 2000-07-01, the transitional lapse reference is 2020-07-01, unlike the original-notice basis for a 10-year claim. Park, public-land and former National Land Use Management Act exceptions require separate review.

1. Original notice and evidence

2. Actual filing and decision notice

The planning authority’s 3 months and deciding authority’s separate 2 months are independent. No automatic sum, release or entitlement to a follow-up application is inferred.

3. Possible bond payment · hypothetical present value

For a local-government purchaser and qualifying absentee/non-business land, the excess over KRW 30 million may be paid in bonds even without consent. This models the full permitted excess, not actual issuance, a statutory rate or appraised compensation. Blank and zero differ.

PV = Σ(principal × coupon rate / (1 + discount rate)^t) + principal / (1 + discount rate)^maturity. Taxes, market sale and payment delays are excluded.

Interpretation and cautions

  • All 6-month, 2-year, 3-month and 2-month dates are nominal, without holiday adjustment. Confirm start-day, end-day and holiday rules with the authority.
  • Elapsed time alone establishes no purchase claim, release, lapse or building permission.
  • Bond PV assumes annual year-end coupons and principal at maturity; it is not a statutory bond structure or market price.
  • Unverified or assumed evidence prevents a determination. The example does not verify facts.
  • Period basis unknown: 10/20-year dates are references only. Confirm Administrative Basic Act article 6 and Civil Act articles 157, 160 and 161.
  • Special rules excluded from automatic assessment: 10 years without a park development plan, 30 years for state/public park land with one extension up to 10 years, and the 2003-01-01 transitional start for former National Land Use Management Act public facilities/buildings.

Related calculators

1. Three different routes for long-unimplemented facility land

Land designated for a road, park or other urban planning facility can remain restricted even when construction has not started for many years.
This calculator organizes the facts to check before considering a land purchase claim, confirming the lapse of a facility decision, or applying for initiation of a cancellation plan.
It applies Korean law using the 2026 rule set, not international land acquisition rules.
A long waiting period alone does not establish a purchase entitlement or permission to build.
The original decision notice, implementation status, land-register category, ownership and special provisions all matter.

A checklist, not an administrative determination

Results identify questions for the responsible authority and do not replace legal advice or an official decision.
The tool does not predict an appraisal, compensation amount or sale price, and cannot conclusively establish a lapse date or development right.
Do not start work or commit to contract terms merely because a reference date has passed.

2. Prepare documents and preserve unknown information

Enter the first effective facility decision notice date, reference date, registered land category, ownership, implementation status and implementation-plan approval status.
A recent amendment notice is not necessarily a new starting date: ask how the decision has continued for your particular parcel and facility section.
Where only part of a project has been implemented, the remaining section requires its own review.

  • Compare the land-use planning certificate with the original and amended notices to identify the facility and affected section.
  • Use the land register and property registration certificate to verify category and ownership.
  • Ask the planning department about implementation, plan approval or equivalent procedures, and the phased execution plan.
  • Keep receipt records and the actual purchase decision notification; mailing and receipt dates may differ.

Unknown is different from no: lack of a document does not establish that no project exists.
A confirmed source should have an identifiable origin and a verification date between the relevant notice and the reference date.
A blank amount means missing information; zero means an actual zero amount.
Values supplied by the example button remain assumptions, not findings about your property.
Keep the reference date and source status visible when discussing the result with an official.

3. Purchase claim review: ten years and registered category 대

Article 47(1) of the National Land Planning and Utilization Act addresses facilities not implemented within ten years of the facility decision notice.
The general purchase-claim route concerns the owner of land registered as 대, a Korean cadastral category, within the facility site.
Implementation-plan approval or an equivalent procedure and other exclusions must also be checked.
Do not treat ten elapsed years as sufficient for every parcel or every owner.

A review candidate is not confirmed eligibility

A candidate result means the entered general conditions support further review.
A non-owner or land registered as field, paddy or forest is not automatically covered by this particular route.
Unknown facts or special provisions require additional confirmation.
Ask the authority to identify both the eligible land and the party legally responsible for purchasing it; structures, rights and partial implementation may require extra documents.

4. Twenty-year lapse references and period-counting assumptions

Article 48 provides for loss of effect on the day following the end of the twenty-year period where the facility project has not been implemented.
However, inclusion of the initial day, transitional provisions and implementation-plan approval affect the legal analysis.
The tool therefore separates unknown, initial-day-inclusive and initial-day-exclusive assumptions.
With an unknown basis, adding ten or twenty calendar years to the notice date gives an arrival reference, not a confirmed legal lapse date.

One notice date, two nominal references

For an assumed notice date of 2006-10-20, the inclusive mode gives a nominal lapse reference of 2026-10-20 and the exclusive mode gives 2026-10-21.
These are alternative counting assumptions, not an invitation to choose a preferred legal result.
Confirm the relationship between Article 6 of the General Act on Public Administration and Civil Act Articles 157, 160 and 161, including end-of-period and holiday treatment.
Calendar references do not finally resolve public holidays, special procedural rules or the actual administrative determination.

5. Older decisions and urban parks need special review

Article 16(1) of the relevant addenda provides a 2000-07-01 starting point for the general lapse period of decisions made before that date.
The corresponding general lapse reference is 2020-07-01, subject to implementation and other applicable provisions.
Do not also reset the purchase-claim ten-year period to 2000 automatically: its original notice date must be considered separately.

Former public facilities and public-use buildings under the former National Land Utilization Management Act may instead involve the 2003-01-01 starting-point rule in addenda Article 16(2), affecting both purchase claims and lapse.
These cases are excluded from automatic determination under the general ten-year and twenty-year model.
Check the legal basis named in the old notice and how the decision was transitioned or deemed effective; the everyday description of an old road is insufficient.

Article 17 of the Act on Urban Parks and Green Areas includes separate rules concerning failure to announce a park development plan within ten years and a thirty-year rule for relevant national or public urban-park land, with a possible single extension of up to ten years.
Not every park receives the same exception, and the thirty-year rule must not be applied to every privately owned park parcel.
Verify park-plan notices, public ownership and any extension notice before relying on a general reference date.

6. Six months from receipt; two years from actual notification

  1. Confirm when the authority actually received the purchase claim.
  2. Calculate the nominal decision and notification reference six calendar months from that receipt under Article 47(6).
  3. Enter the actual date on which the decision to purchase was communicated separately.
  4. Calculate the nominal purchase reference two years from that notification and check whether purchase was completed.

Do not substitute the claim receipt for a notification

An assumed claim received on 2026-04-20 produces a nominal decision reference of 2026-10-20.
If the purchase decision was actually communicated on 2026-10-20, the nominal purchase reference is 2028-10-20.
Without an actual purchase decision notification, the purchase date remains unknown.
Adding six months and two years to the original receipt does not establish the actual purchase deadline.
A refusal is a separate branch; future receipt and notification dates describe planned scenarios rather than completed events.

Where a corresponding day does not exist in the target month, the tool uses month-end as a calendar reference.
Ask the receiving authority about holidays, service and any procedural issues.
Passing a nominal date does not itself establish compensation or complete the purchase.

7. Applying to initiate cancellation is not automatic cancellation

Article 48-2 provides a cancellation-plan initiation application route where a project has remained unimplemented for ten years and no phased execution plan has been established through the lapse horizon.
Unlike the Article 47 purchase route, it should not be screened simply by requiring registered category 대.
Not finding a current plan is different from verifying the absence of the legally relevant phased plan through the lapse horizon.
Request the actual plan and its applicable period.

The three-month stage before the planning initiator and the two-month stage before the decision authority each begin with their own actual receipt.
Do not add them together and promise cancellation after five months.
Later stages have entry requirements based on earlier outcomes.
The subsequent actual cancellation procedure, including the six-month rule, a two-month simplified case and excluded consultation periods, needs separate review.

Enter a decision-authority application receipt independently of the earlier planning-initiator receipt.
This calculator organizes nominal notification checks, not the actual cancellation completion date, approval probability or legal effect of silence.
Retain each response and its reasons, and check subsequent application or challenge routes against the actual notice and current law.

8. Refusal or non-purchase does not remove permit requirements

A refusal to purchase, or non-purchase for two years after communicating a purchase decision, may open review under Articles 47(7) and 56.
It does not automatically cancel the facility decision or authorize unrestricted construction.
Whether purchase has already been completed is a separate fact that must be checked.

A floor-count check is not enough

Enforcement Decree Article 41(5) sets categories including detached housing of up to three floors, Class 1 neighborhood living facilities, certain Class 2 facilities and structures.
Exact use categories, facility type, local ordinance restrictions, access and other permit requirements still matter.
Take the refusal or non-purchase documents to the planning and building departments to ask which uses and approvals are available.
Do not commit to design expenditure or a construction start solely on the calculator output.

9. Cash and possible land-purchase bond allocation

The bond exceptions in Article 47(2) and (3) must be checked on the premise that a local government is the purchase obligor.
If the owner wants bonds, enter the selected bond amount as a separate scenario.
Even without that preference, qualifying absentee-owner or non-business land may involve possible bond payment for the amount exceeding KRW 30,000,000.
A permissible scope is not an actual confirmed bond issuance.

For an assumed total of KRW 100,000,000, the excess over KRW 30,000,000 is KRW 70,000,000.
This can be compared as a possible upper-bound scenario when the relevant conditions are confirmed.
At or below KRW 30,000,000 the excess is zero, but an owner-selected bond scenario remains distinct.
Do not apply this local-government exception unchanged to another purchase obligor.
An unknown obligor or land classification leaves the possible allocation unconfirmed.

Check the statutory repayment limit of ten years, the issuance-time interest floor based on the average one-year fixed-deposit rate of qualifying banks operating nationwide, and the applicable ordinance.
A user-entered coupon is not a verified issue rate or statutory minimum.
Confirm actual issuance, payment frequency, early redemption and transfer conditions before substituting real terms for assumptions.

10. Bond present value: formula and worked examples

Present value discounts future receipts using the comparison rate you enter.
The scenario assumes annual year-end coupons and a single principal repayment at maturity.
This hypothetical structure is not guaranteed for every statutory bond; different actual repayment terms require a different analysis.

Reproducible scenario

PV = Σ[bond principal × annual coupon ÷ (1 + discount rate)^t] + bond principal ÷ (1 + discount rate)^n
Cash = total − bond principal / combined present value = cash + PV
Difference from nominal total = total − combined present value

Assume total KRW 100,000,000, cash KRW 30,000,000, bonds KRW 70,000,000 and a five-year maturity.
With both coupon and discount rate at 0%, PV is KRW 70,000,000 and the difference is KRW 0.
With a 2% coupon and 4% discount rate, rounded PV is KRW 63,767,449, combined present value is KRW 93,767,449, and the nominal-total difference is KRW 6,232,551.

The difference is neither a realized loss nor an after-tax result, and it is not a market resale quote.
It can be negative when the coupon exceeds the discount rate.
Taxes, fees, early sale pricing, inflation and credit risk are not separately modeled.
Review actual terms when comparing liquidity needs or a private sale offer.

11. Frequently asked questions

Does ten years guarantee a purchase claim?

No.
Ownership, registered category 대, non-implementation, plan-approval exclusions and special rules must be checked together.
Confirm eligible land and the purchase obligor with the authority.

Can I build after the twenty-year reference date?

Not on that basis alone.
Confirm counting rules, implementation, exceptions and actual lapse, then review development and building permits separately.

Does every park follow only the general twenty-year rule?

No.
Unannounced park development plans, national or public land, and extensions need separate review.
The calculator does not conclusively determine these special cases.

Is purchase due two years and six months after receipt?

No.
Decision and notification use six months from receipt, while purchase uses two years from the actual purchase decision notification.
These are different starting events.

Does cancellation happen automatically after five months?

No.
The initiator and decision-authority stages have separate receipts and entry conditions; actual cancellation procedures remain.
Silence is not automatic cancellation.

Does a KRW 100 million total guarantee KRW 70 million in bonds?

No.
That is a possible scope under confirmed local-government and land conditions, not an issuance promise.
The owner’s bond preference is a separate input.

Is the present-value difference my actual loss?

No.
It is a comparison under your coupon, discount rate, maturity and hypothetical repayment structure.
It is not an appraisal, legal damages assessment or after-tax result.

Are saved schedules or printouts legal evidence?

No.
Anonymous TXT, printouts and nominal-date ICS reminders are working notes.
Keep original notices, receipt records and actual notifications, and avoid entering identifying property or personal information.
